The Commission of the City of Bozeman met in special session in the Commission Room, Municipal Building, September 14, 1995, at 4:30 p.m. Present were Mayor Pro Tempore Stueck, Commissioner Youngman, Commissioner Stiff, Commissioner Frost, Acting City Manager Gamradt, City Attorney Luwe and Clerk of the Commission Sullivan. Mayor Vincent was absent. The meeting was opened with the Pledge of Allegiance and a moment of silence. Signing of Notice of SDecial Meetina Each of the Commissioners in turn signed the Notice of Special Meeting. Authorize absence of Mavor Vincent in comDliance with Section 7-3-4222(2), M.C.A. . Mayor Pro Tempore Stueck announced that Mayor Vincent is absent from this meeting due to the death of his father on Tuesday in Washington. It was moved by Commissioner Youngman, seconded by Commissioner Stiff, that the Commission authorize the absence of Mayor Vincent from this meeting, in compliance with Section 7-3-4322(2), M.C.A. The motion carried by the following Aye and No vote: those voting Aye being Commissioner Youngman, Commissioner Stiff, Commissioner Frost and Mayor Pro Tempore Stueck; those voting No, none. Commission Resolution No. 3080 - levving and assessing sidewalk assessments for 1993 and 1994 Sidewalk Programs; set Dublic hearina for SeDtember 26. 1995 Acting City Manager Gamradt submitted Commission Resolution No. 3080, as __aPProved by the City Attorney, entitled: COMMISSION RESOLUTION NO. 3080 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, LEVYING AN ASSESSMENT AND TAX AGAINST EACH LOT OR PARCEL OF LAND IN FRONT OF WHICH SIDEWALKS, CURBS, GUTTERS, AND ALLEY APPROACHES OR ANY COMBINATION THEREOF HAVE BEEN CONSTRUCTED UNDER ORDER OF CITY COMMISSION DATED JUNE 28, 1993, FOR THE 1993 SIDEWALK PROGRAM, AND 09-14-95 Special - 2 - UNDER ORDER OF CITY COMMISSION DATED JULY 5, 1994, FOR THE 1994 SIDEWALK PROGRAM, TO DEFRAY THE COST OF CONSTRUCTION OF SAID SIDEWALKS. CURBS, GUTTERS AND ALLEY APPROACHES OR ANY COMBINATION THEREOF. The Acting City Manager stated that, by adoption of this resolution, the Commission is authorizing these assessments at an interest rate of % percent higher than the interest rate . on the warrants, to cover administrative costs. He noted that this additional interest is allowed under State statutes and is included in the resolution for sale of warrants for the 1993 and 1994 sidewalk programs. It was moved by Commissioner Stiff, seconded by Commissioner Frost, that the Commission provisionally adopt Commission Resolution No. 3080, levying and assessing assessments for the 1993 and 1994 Sidewalk Programs, and set the public hearing for 7:00 p.m. on Tuesday, September 26, 1995. The motion carried by the following Aye and No vote: those voting Aye being Commissioner Stiff, Commissioner Frost, Commissioner Youngman and Mayor Pro Tempore Stueck; those voting No, none. City Attorney Luwe announced that at Monday's regular meeting, the Commission will be provisionally adopting resolutions for annual lighting district assessments and delinquent . snow removal assessments; and those resolutions will also be setting the pUblic hearings for September 26. Adiournment - 4:35 p.m. There being no further business to come before the Commission at this time, it was moved by Commissioner Frost, seconded by Commissioner Youngman, that the meeting be adjourned. The motion carried by the following Aye and No vote: those voting Aye being Commissioner Frost, Commissioner Youngman, Commissioner Stiff and Mayor Pro Tempore Stueck; those voting No, none. .
