*Consider a motion approving the Minutes of June 16, 2008 and the June 25, 2008
Policy Meeting as submitted.
G. Consent
1. Authorize Payment of Claims (LaMeres)
2. Authorize City Manager to sign Release and Reconveyance of Easements
for Emil Anderson and Jessie B. Kemp (Stodola)
3. Authorize Mayor to sign the Findings of Fact and Order for the Village
Homesites Planned Unit Development Major Subdivision Phases 1 and 2
(Windemaker)
*Consider a motion approving Consent items 1-3 as listed above.
H. Public Comment -Please state your name and address in an audible tone of voice
for the record. This is the time for individuals to comment on matters falling
within the purview of the Bozeman City Commission. There will also be an
opportunity in conjunction with each agenda item for comments pertaining to that
item. Please limit your comments to three minutes.
I. Action Items
1. Greek Way Apartments Zoning Variance #C-08004 (Krueger)
*Consider opening and continuing the Greek Way Apartments Zoning Variance #C-
08004 in order to comply with the Unified Development Ordinance Section 18.66.060,
D. 4, stating that the concurring vote of four members of the City Commission (acting as
the Board ofAdjustment) is necessary to effect any zoning variance.
2. Resolution No. 4111, Adopting a Revised Schedule of Application
Review Fees for the Department of Planning and Community
Development, opened and continued from July 21 and August 4, 2008
(Saunders)
*Consider a motion approving Resolution No. 4111, Adopting a Revised Schedule of
Application Review Fees for the Department of Planning and Community Development.
3. Hastings Shopping Center Site Plan #Z-04047/Bozeman Shopping Center
LLC Notice of Violation (Skelton)
*Consider a motion directing City staff to proceed with filing a Notice of Violation as
outlined in Section 18.64.160, Bozeman Municipal Code.
AND
*Consider a motion directing City staff to prepare an Improvements Agreement for
signature by the Bozeman Shopping Center LLC to guarantee completion of all site-
related improvements including the Osco/Hastings facade within one (1) year.
AND
*Consider a motion restricting occupancy of new tenants and new development
proposals until facade improvements are fully addressed, and authorizing City staff to
take further lawful action as is necessary to remedy violation of the Final Site Plan
approval.
4. Reconsideration of the Commission's prior Vote to install a Temporary
Median "Pod" on North Tracy Avenue at its Intersection with Cottonwood
Street (Arkell)
*Consider reconsidering the motion from the May 19, 2008 City Commission Meeting
that was moved by Cr. Krauss, seconded by Cr. Pro Tem Jacobson, and passed 3-1 "to
direct staff to also include a pod' as described by Public Works Director Debbie Arkell
on North Tracy. "
