RELEASE AND RECONVEYANCE OF EASEMENT
COMES NOW the West Winds Master Homeowners' Association, Inc., P.O. Box 1501,
Bozeman, MT 59771, hereinafter ("GRANTOR") and does hereby release and reconvey the
following described easement unto City of Bozeman, 411 E. Main, Bozeman, Montana 59715,
hereinafter ("GRANTEE"), as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a Detention Pond Drainage
Easement recorded as Document No. 2258426, Records of the Clerk and Recorder, Gallatin
County, Montana, situated across the Grantee's tract of land located in the Northwest Quarter of
Section 2, Township 2 South, Range 5 East, P.M.M, Gallatin County, Montana, in West Winds
Subdivision Phase 2A, as described in Records of the Clerk and Recorder, Gallatin County,
Montana.
WHEREAS the above Detention Pond Drainage Easement was granted on February 27,
2007 and recorded on March 2, 2007 at the Clerk and Recorder's Office of Gallatin County,
Montana, and
WHEREAS the detention pond will be relocated during construction for the
improvements to West Winds Phase 4 Subdivision and the use of said easement recorded on
March 2, 2007 was temporary for public drainage detention pond purposes until construction of
the Phase 4 improvements, the vacation of said easement will not adversely impact the Grantor's
interests.
WHEREFORE, the Grantor does hereby release and reconvey to the City of Bozeman
said easement recorded on March 2, 2007 together with any right, title, or interest that the
Grantor may have in said easement.
