HomeMy WebLinkAboutResolution 4129 Supporting the $32,000,000 General Obligation Bond Proposed by the Gallatin County Commission to Fund the Acquisition, Design, Construction, Equipping and Financing of an Adult Detention FacilityCOMMISSION RESOLUTION N0.4129 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA SUPPORTING THE $32,000,000 GENERAL OBLIGATION BOND PROPOSED BY THE GALLATIN COUNTY COMMISSION TO FUND THE ACQUISITION, DESIGN, CONSTRUCTION, EQUIPPING AND FINANCING OF AN ADULT DETENTION FACILITY ON PROPERTY OWNED BY GALLATIN COUNTY AT THE LAW AND JUSTICE CENTER SITE. WHEREAS, in 1982, the City of Bozeman entered into an agreement with Gallatin County under which the Detention Center provides jail facilities for prisoner services for arrests made by the Bozeman Police Department and sentenced by the Municipal Judge; and WHEREAS, numerous studies have revealed the need to update and expand Gallatin County's detention facilities; and WHEREAS, the lack of adequate detention facilities has resulted in a decline in the ability to provide for the safety of the residents of the City of Bozeman; and WHEREAS, there has been an increase in crime and the number of offenders that need to be incarcerated in a place with sufficient size and capacity for immediate incarceration after conviction; and WHEREAS, the Gallatin County Commissioners has placed on a general election ballot the proposition fora $32,000,000 bond to fund the construction of a new detention center; and WHEREAS, the present facility has become mostly a felon only holding facility; and WHEREAS, the present situation is inconsistent with law enforcement policy of arresting offenders who need to be immediately incarcerated in a facility which is sufficiently large to hold them; and WHEREAS, the present status of the detention center does not provide that assurance. NOW THEREFORE BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that it support the proposition to "issue and sell general obligation bonds of Gallatin County in the amount of up to $32,000,000 to be payable during a period not to exceed 20 years from the date of issuance, the proceeds of such bonds to be used to fund the acquisition, design, construction, equipping and financing of an adult detention facility on property owned by Gallatin County at the Law and Justice Center site in Bozeman." PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 29th day of September, 2008. ~/~'~.
