Home My WebLink AboutResolution 4124 Solid Waste Collection FeesCOMMISSION RESOLUTION N0.4124 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ESTABLISHING SOLID WASTE COLLECTION FEES WITHIN THE CITY OF BOZEMAN, MONTANA TO INCLUDE A DEPOSIT FOR TENANT CUSTOMERS. WHEREAS, the City Commission of the City of Bozeman did adopt Ordinance No. 1493 on the 17`" day of May 1999, providing for the billing of solid waste collection fees on a monthly basis; and WHEREAS, said Ordinance No. 1493 provides for the setting of fees by resolution; and WHEREAS, the Bozeman City Commission did regularly pass Commission Resolution No. 4108 on the 30`" day of June, 2008 which Resolution established a revised solid waste collection fee schedule; and WHEREAS, Section 8.16.OSO.A.3, Bozeman Municipal Code states that delinquent solid waste fees shall be a lien against the property; and WHEREAS, Section 8.l 6.020.C of the Bozeman Municipal Code stipulates that the owner or occupant of a property may arrange for solid waste service from the City of Bozeman; and WHEREAS, because the occupant of a leased or rented property is not the property owner, a tenant who subscribes to a solid waste service with the City of Bozeman where the property owner has not assumed, in writing, the obligation to pay the solid waste bill on behalf of the tenant or lessee, shall make a cash deposit for the service, as outlined in Schedule A, attached hereto; and WHEREAS, said deposit shall be retained by the City until the time said service is discontinued. No interest shall be paid to the customer on the amount deposited; and WHEREAS, should the solid waste bill not be paid on time, the service will be terminated, the deposit shall be used to pay the amount due, and the property owner will be contacted by the City and be required to either obtain service from the City or to provide proof that the service is being provided by a licensed private solid waste collection service. WHEREAS, the City of Bozeman continues to incur additional costs in its operation of the callection and disposal of solid waste. NOW, THEREFORE, BE 1T RESOLVED, and it is hereby ordered by the Commission of the City of Bozeman, State of Montana: Section 1 A tenant ar occupant of real property who subscribes to a solid waste service with the City of Bozeman where the property owner has not assumed in writing the obligation to pay the solid waste bill shall provide as a condition of service a cash deposit for the service as provided in Schedule A attached. This schedule may be amended from time to time at the direction of the Bozeman City Commission. This deposit will be applied to any outstanding bill at the time of discontinuance of service and will not accrue interest. Section 2 A tenant or occupant of real property who subscribes to a solid waste service with the City of Bozeman where the property owner has not assumed in writing the obligation to pay the solid waste bill shall provide the City of Bozeman with the name and address of their landlord. The City shall send, by certified mail, a letter to the landlord notifying the landlord of the service and the effect of Section 8.16.O50.A.3, Bozeman Municipal Code. Section 3 To defray the estimated cost and expense of collecting and disposing of solid waste in the City of Bozeman, there is hereby established a schedule of fees to be levied upon all users of the City's solid waste collection system and those not served by a licensed private solid waste collection service, as set forth in Schedule A, attached hereto, and by this reference made a part hereof. Whenever specialty materials, such as tires, building materials, or scrap metal, or any combination thereof, exceed 50 percent of a dumpster's contents, then the per cubic yard dumpster capacity dollar amount shall be increased in accordance with the specialty material landfill fees established by the Gallatin Solid Waste Management District. This deposit will be applied to any outstanding bill_at the time of discontinuance of service and will not accrue interest. 2.
