Requests far Waivers fear LaandSill 1"ippir~g Fees Chairman Bruce Hanson opened discussion on the requests to the Gallatin Solid Waste Management District to waive tipping fees and deposits far their businesses. Amber Houser, Manager Sacks of Bozeman (presented a report on behalf of Sacks of Bozeman and Belgrade, to the Board that identified businesses that actively support and contribute to the mission of recycling in Gallatin Gounty); Cal Hultman, Restore General Manager for Habitat far Humanity; Tim Trzinski, Assistant Program Director, Gallatin Food Sank; and Elaine Dale, Manger Sacks of Belgrade, presented their requests for the Logan Landfill to waive the tipping fees for their businesses. Their reasoning is they are part of the recycle industry. The City of Bozeman previously had waived tipping fees for the entities. Naw that the City of Bozeman is no longer available, the cost of fuel to the Logan Landfill and paying the tipping fees has became a hardship. They all agreed that by being in operation, they have saved lots of materials from going into the landfill needlessly, recycled back to people in need. The missions of the entities and the Gallatin Solid Waste Management District can work together to further recycling goals in Gallatin County. In Board discussion, they discussed the after hour dumping issues. Items are left they end up paying to dump that cannot be recycled or sold such as non-working refrigerators. They have had to pay to get the Freon removed. They are working on improving security. They try their best to find homes for all the materials received, but some are just not reusable. A suggestion was made to enter into agreements with the businesses who have requested waivers based on whether they meet the district goals and objectives of recycling, in order that the District can measure the value of their return. The organizations can provide an accounting on how they met the goals and objectives of the District. Some members suggested waiting to make a policy decision until after the recycling manager is hired. The person will be working with these organizations to market more recyclable materials. It was argued that it is simpler to track at the scale house and by the manager if you keep track of the materials coming in with a fixed amount allotted by the board. The recycle manager will not have any market in the items that are hauled out for recycling, because at that point, it is junk. However, the new recycling manager will help by finding more markets, education, and outreach that will remove even more materials from the waste stream. It was stressed by a Board member, and agreed by all the members, it is important that the District stay within their mission to make sure the criteria of the organizations are recycling. Sweet Pea, Taste of Bozeman, and the County Fair are events the City of Bozeman waived tipping fees For but they are events that profits are made. Members agreed those type of requests should not be waived. Chairman Bruce Hanson agreed the Board could work an trying to set some parameters to form a policy. A lot of decisions need to be made first. It would have to be well written to define who qualifies ar not, the way in which the District would waive fees, based by volume, up to a certain tonnage, or give a credit, or maybe a reduction in fees. He agreed the District needed to stress that to qualify; they would have to prove they are involved in recycling. The Board agreed to form a committee to work on drafting language that will be made into a resolution. Gallatin County Solid Waste Management District February 20, 2008 Minutes 2 Deputy County Attorney James Greenbaum agreed to work with the Board on drafting the language For a policy. agenda Item 7.1. Groundwater and Well Test Results (Moved by Chairman) Chairman Bruce Hanson reported tests were authorized and conducted by Great West Engineering, Senior 1-Iydrologist, on two properties and Logan Springs. Letters were sent to the citizens who attended the January meeting and had expressed their concerns. Trace chemicals were found that were below the reporting limit. Wendy Evans responded that she did receive a letter. She did acknowledge the letter said there were trace amounts of chemicals, but expressed concern for the 10-15 years she has lived on the property that she has oat been able to get tests on. She requested a copy of the whole report. Chairman Bruce Hanson responded the Board does not know the history prior to the District. In the 80-s and 90's different rules and practices were followed. The Department of Environmental Quality (DEQ) requires ground water monitoring. The landfill has the records of groundwater monitoring results at DEQ. The District does not know the source ar the Cause of the concentrations, but are working to evaluate and identify appropriate steps to be taken. DEQ has been notified, as well as, the Gallatin County Health Department, and the Local Water Quality District. The District and the County will continue to work all involved. The wells will be monitored quarterly. Wendy Evans and Brent Miller asked if their wells can be included in the monitoring. The Board agreed to include the wells in the quarterly monitoring. A full report of the test results will be mailed out to them by the Board secretary. Commissioner R. Stephen White agreed to follow-up with them. Financial Reports 4.1. The Board responded that the revenue and tonnage comparisons are down for the past three months. The Board acknowledged that the construction ittdustry is down here as well as the rest of the country. Gallatin County Solid Waste Management District February 20, 2008 Minutes 3 There was a question on why municipal solid waste was down. The Manager responded he would look into it. 4.Z, Bob I?ellinger, Dellinger & Gallagher, Inc. -December s1, 2007, Compilaticm Report Bob Dellinger, Dellinger & Gallagher, Inc. presented the Gallatin Solid Waste Management District financial Statements for the Quarter and Six Months Ended December 31, 2007. In Board discussion, they discussed the Cash flow Statement. It indicates where the revenue is coming in and where it is being spent. The cash flow analysis was based an 5-1 D years of the operation. The reserve fund set up for equipment is expected to start paying cash next year. A rotation schedule has been set up for the pieces of equipment, with a couple of exceptions. They will be getting delivery of the financed dozer in March. They are expecting to run on a cash basis within the next 12- 1 S months. They expect to acquire land, operate recycling sites and household convenience centers. Board Member Steven Hamilton moved to accept the updated financials reports forJanuary 2008. Contract for the Shop attd Administration Building PER Contract to Dawli~tg 5aandholm Architects - Larry Watson Larry Watson, Grants and Projects Director, reported the kick-off meeting was held followed up by another meeting. He presented the latest draft contract developed after the meetings. The contract has some language modifications that were required. The dollar amount of the agreement for services is for $47,160, which is the same, as well as the scope of work. Stahley and Associates is the subcontractor far the architects. The contract is waiting far county attorney review. Board Member Storm Shirley presented the first generation of floor plans for the administration building and shop for the Board to review. The Board asked and found that there would be not be a wash bay in the shop. They are researching a tube bay. They recommended getting away from handling barrels. They need room for the mechanicals; the reels for the lubrication are high. They agreed they would like to see the next generation of drawings when they are ready. Larry Watson, Grants and Projects Director, reported he had the proposal for the Geotechnical Evaluation for the Administration and shop buildings. The proposal is for $8,100. It is not in the farm of a contract yet. It will have to be reviewed by legal. Seconded by Board Memb+et Steven White. AU voted aye. Motion carried. (Motion# 48- o22oos-osl Larry Watson responded that he will review the invoice and make a recommendation to the Board. James Greenbaum, Deputy County Attorney, said he needs to have a discussion with the County Attorney to work out the process with the level of legal oversight with the District. He can draft a process for the Board to meet their needs. He recommended not getting signatures until receiving County Attorney approval. The Board discussed the need for the County Attorney's Office to work with the board in a timely manner for the level of activities they require to operate the business. Update on the Hauling Contracts - I.~rty Watson Larry Watson, Grants and Projects Director, reported the hauling contracts still need specifics to get the County Attorney's approval. The sites are still not decided. The haulers that agreed to be backup for the hauls, was not in the original solicitation. That language will need to be added to the contract. The Board responded that they need to get a legal resolution on these contracts. The bids went to the press, were awarded, and the haulers need to get their contracts. Larry Watson responded, he needed the minimum sites. In discussion with the District Manager, he said he had been pulled off the project. The new recycle manager would be involved in formalizing them. District Manager Tom Miller responded that was his understanding. He was to order the bins, which he did, and they will be arriving nett week. Board Member Steven Johnson responded that they lost the West Babcock site. A construction company moved in. As of February 29t~ it will no longer be available. It will create more pressure on the remaining sites. Dave Leverett, 1"our-Corners Recycling, responded he would work with District Manager Tom Miller and Board Member Storm Shirley to start the preliminary stage of getting the ground work done, working towards Gallatin County Solid Waste Management District February 20, 2008 Minutes 5 finalizing the sites and getting agreements with them so they can get them to Larry Watson. The Soard agreed it will need to get more sites along Jackrabbit and Faur~Corners area. They proposed the start-up date will be April 1st so the sites will have to be finalized by then and the bins in place. 5.3. Update on Rolloffs and Cardboard. Container Contracts -- Larry Watsar- The bid recommendation was to award it to Rule Steel in the amount of $150,000. The District Manager ordered the bins, but the contract documents are not in place. The invoice will not be able to be paid until the contract is in place. The County Attorney's office will review it to make sure all the legal requirements are met, insurance and warranty. He asked if the bid award had been sent out. District Manager Tom Miller said he sent the bid award out. 5.4. Update on the Recycle Program Manager ~- Storm Shirley Board Member Storm Shirley reported he received four applications. The committee will be interviewing an applicant that looks promising tomorrow at 11:00 a.m. in the 301 conference room. A list of questions has been prepared for the applicant interviews. Board Members' Steven White, Steven Johnson, Jody May, and Chairman Bruce Hanson agreed to attend the interview. 6. New Business 6.1. Capper Colleckion Ama Baax+d Discussion -- Commissioner R. Stephen White Soard Member Steven White requested the landfill start recycling copper as the responsible thing to do as a District. As a commodity it is valued. The current market is around $3.49 per pound. The landfill has a place for white goods, wire, and wood, it should make a place to store copper. He estimated if it was taken to Pacific Steel for recycling, it could bring in extra revenue of about $2,000 a month or more. The Soard discussed the issue. They felt it would be worth doing. They agreed to discuss it with the new recycle manager. Others felt it would not be a good idea, once people figure out the landfill is keeping copper on site, it would make the landfill a target for people who would try and steal it. Baard Member Steven White wanted assurance that employees were not savaging copper onsite. Gallatin County Solid Waste Management District February 20, 2008 Minutes 6 District Manager Tom Miller assured him his employees have not salvaged any copper from the landfill. 7. Chairman Report -Brune Hanson 7.I. Groundwater and Well Test Resulfis -moved after agenda Item 3. Chairman Bruce Hanson asked Debbie Arkell, City of Bozeman Public Works Director, to respond to the draft, "Interlacal Agreement for Operation of Convenience Site and Household Hazardous Waste Facility Between the Gallatin Solid Waste Management District and the City of Bozeman," sent to him. Debbie Arkell, City of Bozeman Public Works Director, responded as of July 1, 2008, the landfill would be closed according to the Interlocal Agreement between the City and the District. They propose, after the closure of the City landfill, the District would take over the Convenience and Household Hazardous Waste Station the City currently operates. They would continue City operations within the landfill and continue to operate the compost facility there. Chairman Bruce Hanson asked if the District could expect the recycle manager to be able to work out of the office on site. She responded that the building is dilapidated; the restraom is separate from the scale house. The scale house is operational, but the scales do not work. They have a scale house person that has been through HAZWOPER training. They will establish a price on the lease of the facility. The District would pay the utilities. They would ask that the City be contracted to haul the hazardous waste collected at the facility to Logan with na tipping fees at the scale. The Board agreed to look at the document and give their input. The issues will need to be clearly defined, such as, will it be under the charge of the District Manager or the Recycling Manager? Board Member Steven Johnson offered a tour to employees and Board of the Gity operation. It will help to get an understanding of what is proposed in the agreement. The City representatives agreed to bring the financials of the operation to the next Board meeting. Board Members' Jody May and Storm Shirley will make arrangements with Board Member Steven Johnson for a tour. They will email the time and date for the Board. The Board agreed that the County Attorney will have to be consulted regarding contracting the City for hauling, through an interlacal agreement between a municipality and a District, verses the District having an option to put it out Far bid. 8. District Manger Report - Tvm Miller Gallatin County Solid Waste Management District February 20, 200$ Minutes 7 District Manager Tom Miller opened discussion regarding the next year's annual budget. In the next few months a new budget will be written, He will need direction on haw the Household Hazardous Waste facility will impact the operational budget. It is critical that they get it all resolved as soap as possible. He reporked the finance committee meets once a month. This month's discussion included Cell 2 and Cell 3, with Cell 2 with I2-months of use and Ge11 3 with the anticipated life of 5.7 years. The current amortization schedule involves four years. If Ce112 is paid off in the next 12 months, it will double the monthly reserve from $ x 2,000 to $25,000, plus it gets paid off. The Ce11 3 life of 5.7 years has afive-year amortization schedule, the argument is the tonnage going in and compare the two if the schedule is correct in getting it paid off at the end of the useful life. He was being conservative now, but plans on paying off Cell 3 before it is full. The Board agreed that the cash flow will not be totally correct, It will have to be analyzed further. The change in elevation for Ce112 extends the life. There is a real value to that space. It is a good option to have the ability to decide to work in the back on windy days or back on top on calmer days. The District Manager does want to avoid using two working faces to avoid covering and compacting two faces. His plans are to get Class 4 materials out of the lined cell altogether. He reviewed the items budgeted this year. He plans on having a bid for an Integrated Tool Carrier far the next board meeting. The Board did not formally approve the purchase by motion, but okayed the budget earmarked for that piece of machinery. The Board requested he keep Larry Watson and the County Attorney's Office in the loop. He also intended to purchase a service truck for $30,000. It will affect the cash flow. There are two unbudgeted needs: I .) a new process for alternative daily cover (ADC) . He recommends abandonment of the current ADC system. He intends to come up with a recommendation for a tarp package and present it to the board with a cost analysis. 2.) A vacuum truck for getting litter off the fences and the side of the highway. A small vacuum system was purchased, but it does not meet the needs. He needs a 100 horse power suction motor to do the job correctly. They range from $50,000-$300,000. He asked to have the Board authorize him to go ahead and look within an affordable range and get it in the budget. The Board agreed, and recommended to request a live demonstration, or rent a vacuum truck before purchasing another one, to see if it would handle the jab. Board Members Rich Allison, Steven Johnson, Steven Hamilton, and Steven White asked first to see more research. They would like to be notified and attend if a demonstration is done. Gallatin County Solid Waste Management District February 20, 2008 Minutes 8 District Manager Tom Miller responded he had a demonstration set up for the alternate daily cover but the person quit and has not been replaced.
