Gallatin County Solid Waste Management District March 19, 2008 Minutes 1. Public Comment Chairman Bruce Hanson called for public comment. Mr. Wayne Brewer spoke regarding the neighbors water issues. He wanted an update on what was being done. Commissioner R. Stephen White responded he would facilitate a meeting with the concerned citizens. He will ask that the Local Water Quality District, Environmental Health Department, and Great West l;ngineering be present to answer questions regarding the reports and the monitoring at the landfill. It will be a chance to have specific dialogue and answer questions. He collected the names of the neighbors present. He will notify them of the meeting. Lorrie Brenneman commented on the blowing garbage between the freeway and the frontage road. She noted the fields of plastic bags. Chairman Bruce Hanson responded that the landfill has been working hard on mitigating the litter problems with new perimeter litter fencing, portable litter catches, and the crew picking the litter daily. She responded she knew they were working on it, but she just wanted to point out it is still a problem. Board Member Steven Hamilton commented on the Logan Landfill brochure and the Annual Report included in the packets. He thought they were done with a high level of professionalism. He wanted staff to know it was a job well done. 2. Approval of Minutrces for the February 20, 2008, Gallatin Solid Waste M~~~ap**~-p•,t District (SWMD) Regular Board Meeting Minutes. District Manager Tom Miller requested an amendment to February Z0, 2008, Minutes, Page 3, Item 7.1. Groundwater and We11 Test Results: "The Board agreed to include the wells in the quarterly monitoring." He said it needs to read, "the wells will be included in the well monitoring that will be done on asemi-annual basis." Boaz~d Member R. Stephen White moved to approve the February Z0, ZOD8, Minutes as amended, Page 3, Item 7.1. Ground water and Well Test Results' "The Board agreed to Include the wells In the monitoring on asemi-annual basis rather than quarterly. " Seconded by Board Mentb~er Steven,/ohnson. " All voted aye. Susan Dellinger, Gallatin Solid Waste District Accountant Susan Dellinger, Gallatin Solid Waste District Accountant, submitted for Board review the following: Gallatin Solid Waste District Profit & Loss July 2006 through June 2007; Gallatin Solid Waste District Profit & Loss Budget Vs. Actual July 2007 through February 2008; Gallatin Solid Waste District Balance Sheet as of February Z9, Z008; Gallatin Solid Gallatin County Solid Waste Management District March 19, 200$ Minutes Z Waste Management District Transaction Detail by Account February 2008; Operational Reports February 1-29, 2008; Graphs Incoming Tonnage by Month Comparison & Projected Revenue by Month Comparison February 1-29, 2008; Memorandum update on the status of charge accounts as of March 11, 200$, at the Logan Landfill, balances over 60 days; Aged Summary Report dated February 29, 2008. She reported the District received approximately $66,000 in revenue from the scrap metal this past month. She noted that she had to estimate the monthly interest for,january and February at $1 T,000, because it had not been pasted by the County. It was pasted in March, and it was actually $5,600. The District has utilized 6796 of its budget for the year. 4.2. Bab Dellir~r, Uellit~$'er & Gallaghear, Inc. -January 3I, Z008, Compilatiar- Report Bob Dellinger, Dellinger & Gallagher, Inc. presented the Gallatin Solid Waste Management District Financial Statements for the Month and Seven Months Ended January 31, 2008. He commented January was the slowest month. Board Member Steven Hamilton moved to $ccept the financials far Maz~ch as preesented. Seconded by Board Member Steven White. All voted aye. Motion caxried (Motion# OS-431908-OZ). 4. Old Business 4.I. Interlacal went for Operation of Convenience Site dE Household Hazardous waste Manageexnent District Discussion - Bruce Hanscm/Debbie Axmell Debbie Arkell, City of Bozeman Public Works Director, reported she drafted the interlocal agreement far consideration by the Board. She thought the City could lease the facility far $1.00, depending on legal authorization. The District will have to provide the containers. The scalehouse has a computer with WasteWorks, but the scales do not work. Restroom facilities are in another building. The power is an separate meters. The name would just have to be switched over to the District. The draft agreement has the District taking it over by July 1. Chairman Bruce Hanson recommended setting up a subcommittee to work on the details. The new budget should include a new position for a scalehouse attendant. He wanted the Human Resource Department and the Commission informed, so that once the position is advertised, the current employee will have an opportunity to apply for the position, Board Member Steven Hamilton said he could be on the committee after the first week in April. Board Member Steven Johnson offered a tour of the facility. Gallatin County Solid Waste Management District March 19, 2008 Minutes 3 Board Member Jady May agreed to be on the committee, He will set up a meeting with Board Member Steven Johnson to tour the facility. He will report back to the Board. The Board discussed adding to the budget a request for up to three FT employees far the household hazardous facility and convenience station. They agreed to have the committee work on it, and report back to the Board and the County Commission. 4.Z. Policy Language Di~cus~ion fur Waiver of '1Tipping Fees/Depos~it Requirement Requests -Bruce Hanson Deputy County Attorney James Greenbaum submitted a draft Resolution to Allow Reduced Tipping Fees for Qualified Not for Profit Corporations Doing Business in Gallatin County. He reviewed the document language. It gives the District the authority to adjust fees as they see fit. One issue was how was the District going to supervise their sites? He referred to #5. "The Business has written policies and procedures, proper facilities and security for the purpose of minimizing the accumulation of waste and preventing its premises from becoming an attractive or reasonable alternative to the proper deposit of waste at the Logan Landfill." It will put the burden back to the nonprofits to come up with a standard on their awn. In Board Discussion, Board Members agreed they were comfortable with the language in the document. They liked the idea of reduced tipping fees, rather than waiving the fees. It encourages them to secure their sites and recycle their goods. A question was asked if this would be under the new recycle program. The Chairman would like the new recycle manager to work with the people to increase the efficiency as time goes on. The program will have to be managed at the landfill. The materials will be dumped there. Ultimately, the materials will be landfilled, but the recycle manager can take a level of responsibility to get mare recycled commodities out of the waste stream first. It might be a joint venture. The recycle manager can inspect sites to see if they are minimizing the waste stream going to the landfill. It will have to be managed, the reduction in tipping fees converted to a budget line item to track it. The cost of doing business at the landfill is $17.50 per ton, The Board agreed that would be the fee. It can change as the cost changes. They agreed if the non_profit does not do their effort to sort, they should look at it on a case by case basis, but the Board will have the authority to recind the agreement if they are nat following the policy and procedures. If time goes by, they are working towards the goals, the District may want to reduce the fee more. Dave Leverett, Four-Corners Recycling, responded there are 35 categories of items that a thrift store receives that are not saleable. He will give the new manager a list of what to take off, and then he can determine from there what is on the recycle list. He can take a look at all the potential profit commodities to get separated out of the waste stream. Gallatin County Solid Waste Management District March 19, 2008 Minutes 4 Debbie Arkell, City of Bozeman Public Works Director, responded, the Food Bank is one group that does not receive any money for their services. You might want to take that into consideration. The Commissioners are discussing community events such as, Sweet pea, Taste of Bozeman; the District might offer a reduction to those events. Motion to accepf the resolution presented, with the $77.5 fee for those who qualify. Seconded by Boarzd Member Stephen White. In Board discussion, Members agreed, non-profits will have to prepare a document for the District to determine who will qualify far a reduced fee. An addendum to the resolution can be done for the Food Bank if needed later. Deputy County Attorney James Greenbaum recommended leaving the $17.50 off of the document. It is drafted that the District wi11 offer a discount on the tipping fees. It will be up the Board to establish. It can change with the cost of doing business. If you put in an amount, and have to change it when costs rise, then it would have to be amended each time. The resolution is a template that gives the District a foundation for administration. Motion to amend the motion to accept the .resolution, omitting the $17.50. Seconded byBoartd Member Stephen White. Further Board discussion found that there were some gray areas that might come into question. They agreed, there should be a clause added that everyone should be charged the same price, determined by the actual operating cost, but thought some might ask who is in charge of determining that cost? Bo$rtd Member Steven Hamilton withdrew the motion on the floor. Board Member Steven White withdrew the second. Board Member Steven Hamilton moved to accept the Resolution to Allow Reduced 7Yppirrg Fees far Qualified Nat for Profit Corporations Doing Business as written, with a set fee determined by the landfill's operating cost based on tonnage, adding a condition that the term of the contracts will bye reviewed annually. Seconded by Board Member Stephen White. All voted aye. Motion carried (Motion# OS-437908-03). 4.3. Update on the Hauling Contrscis Isrcy Wstaoi- Larry Watson, Grants and Projects Administrator, reported the contracts have gone through modifications for services and are being edited for actions of the District and not the County. Once the working document is put together for the haulers, then the scope of work needs to be developed. One contract per contractor, how many sites, location of sites, costs of sites, with mileage and fuel costs to be considered. There are no written site agreements. A majority of the sites have not been negotiated to do a site agreement with the property owners. The other issue to work Gallatin County Solid Waste Management Distniet March 19, 200$ Minutes 5 out in the contract was if the District would utilize the performance bonding with the contractors as a mechanism if a truck breaks down and the hauler fails to provide services, as backup contractual language. In Board discussion, the haulers who were awarded the bid acknowledged they bid the routes different. It was assumed that what price quoted in the contracts for the hauls would be the charge far that route. Allied and the City agreed to be backups to help out the District. It was decided that if there were a break dawn, the lowest bidder would be offered the first chance at hauling the route for the breakdown, then to the next bidder, and last to the highest bidder, verses not contacting the highest bidder first. It would be up to Four-Corners Recycling to arrange for an alternate hauler if their truck broke down, starting with the lowest bidder. The difference in contract price would have to be made up out of the performance band by the District. Once the scope of work is in the document, it will be applicable under change orders above and beyond the contract negotiated price. The contract haulers agreed. The final contracts will be worked out with the attorneys. In the future, if view sites are added, the contract can be modified. There were other details such as 17C. Prevailing wages that needed to be considered with the City, and other haulers will have to lmow if it affects them. Chairman Bruce Hanson asked Phil Idelsan if he would initiate the prepping for the Three Forks City Council location. Board Member Storm Shirley said the Belgrade City Council is waiting for site agreements. Deputy County Attorney Chris Gray responded that the changes in the contracts with any addendums will need to came to the Board for approval. Dave Leverett, Faur-Corners Recycling, agreed he would work with the new recycle manager to work on the agreements. The site owners would have a level of comfort to speak to and know they will have a response from both the manager and the hauler. Debbie Arke11, Public Works Director, agreed to get the template and prevailing wage to the City. Chairman Bruce Hanson wanted to make sure there was an effort made in communicating to the public that glass would not be one of the recycled commodities. He would like to see a PSA done that would explain it to the public. He is getting calls daily. Dave I,everett added that Bill Crane, Headwaters Recycling, will need about a week notice to get his bins out of the locations. The Board thought Mr. Crane could get the bins out of the sites by April 15th. It would give the District a 15 day transition period for the new manager to get up to speed. The bins will be here by then. Gallatin County Solid Waste Management District March 19, 2008 Minutes 6 4.4. Update on Rollaffs and ~ Container Contra~cta -Larry Watson District Manager Tom Miller reported he sent the contracts in the mail. He should receive them back soon. 4.5. Update on the Shop acrd Administratiam Building to Dpwlir~g 5arrdholm Architects -Larry watson Chief Civil Deputy County Attorney Chris Gray reported the contract was delivered February 25th after completing negotiations with them. Based on the minutes of the last meeting, he recommended considering a motion to authorize the Chairman to sign the document on behalf of the District. The amount of the contract did not change. ~n behalf of the District, Board Member Stephen White moved to authorize the Chairman to sign the Shop and Administration Building contract to Dowling and Sandholm Architects Seconded by Ba~r9d Member Steven Hamilton. .All voted aye. Motion carried (Motion# OS- 03I908-04). 5. New Business Chairman Bruce Hanson reported on Montana Rail Link Train derailment that resulted in the landfill stockpiling 2600 tons of coals. He suggested with that much coal on site that the shop consider heating with coal. They did talk about heating with hog fuel as well, but the coal would be enough to heat it far a long time. He also noted that the District discounted the disposal price by $6.00 a ton. 6. Chsirntan Report -Brune Hanson 6.I. Update on Re~ncle Prngratin Manager Chairman Bruce Hanson reported Wayne Shelton has been hired as the new Recycle Program Manager. He will be starting April 1st. District Manager Tom Miller drafted a budget for the program. The budget did not include any other employees, but he will need some back-up far time-off, sick days, vacation, etc. Chairman Bruce Hanson recommended getting approval for 2-3 PI'E's for the program. In Board discussion, Members requested District Manager Tom Miller to have a draft preliminary budget ready to discuss at the next finance meeting. Personal requests need to be submitted to the Human Resource Department by April 1. The committee can work through the issues and make a presentation at the April board meeting. A copy of the Amended District Budget for the District and the Recycle program will be sent to Board Member Steven Johnson. The draft FY09 budget will be presented to the Board as it is worked on until it is ready for approval. An email will be sent to alI board members if they want to attend the finance meeting to work an the budget. The Commission will need to be informed of the personnel requests. Gallatin County Solid Waste Management District March 19, 2008 Minutes 7 Board Member ,Jody May moved to approve an additional three Fl' employees in the District Fl'O9 Budget to meet the April 1 deadline. Seconded by Board Member Storm Shirley. All voted aye. Motion carried (Motion #OS-031908-D4). The Board agreed they would meet with the City of Bozeman far the Household Hazardous Waste Facility. They will discuss the findings and discuss it at the next Board meeting. 7. District Manger Report -Tom Miller 7.I. Integrated Tool Carrier Bid Recommendations JE Award not to exceed ~I 59,897. The following bids were received by the Clerk and Recorder: Tractor & Equipment Co. for a total bid price of $143,972; RDO Equipment Company john Deere) for a total bid price of $146,250; Western Plains Machinery Company for a total bid price of $159,106; and TriState Truck & Equipment for a total bid price of $155,854. The Board asked District Manager Torn Miller for the recommendation to award the bid. District Manager Tom Miller responded Tractor & Equipment as the lowest responsible bidder that met all the needs of the District. He reeomrnended they include purchase of its premiere warranty for $2470, which would bring it to a total of $146,442. He had earmarked $165,000 in the budget for it. Finding the Tractor cPc Equipment Co. bid was the lowest most responsible bidder that met the needs of the District, Board Member Steven Hamilton moved to accept the bid proposal and award the bid for the Integrated Tool Carrier to Tractor & Equipment Co. with the option of the Premiere Warranty for a total of $746,442.
