Box 1230 Bozeman, JKontana S9TT1-1230 PUBLIC STREET AND UTILITY EASEMENT 19`" Capital Group, LLC, a Montana Limited Liability Company, of 19 Lariat Loop, Bozeman, Montana, 59715, the GRANTOR, in consideration of $1.00 and for other and valuable considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal corporation of the State of Montana, with offices at 411 East Main, P.O. Box 1230, Bozeman, Montana 59771-1230, GRANTEE, its successors and assigns, a perpetual access and utility easement for the use of the public, in, through, and across a 15 foot wide strip of land situated in Gallatin County, Montana, and located on the following described real property: Tract 1A of Certificate of Survey No. 2008A, according to the plat there of on file and of record in the office of the Clerk and Recorder, City of Bozeman, Gallatin County, Montana, and located in the Southeast Quarter of Section 14, Township 2 South, Range 5 East of P.M.M.. The easement is more particularly shown and described on the attached "Exhibit A", which by this reference is made a part hereof. The GRANTOR states that it possesses the real property described above and that it has a lawful right to grant an easement thereon. The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTOR. The terms, covenants, and provisions of this easement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors, and assigns of the parties hereto.
