PUBLIC ACCESS EASEMENT
Bozeman School District #7. P.O. Box S20 Bozeman MT 59771-OS20S, GRANTOR, in
consideration of $ 1.00 and for other and valuable considerations, receipt of which is
acknowledged, grants to The City of Bozeman, a municipal corporation of the State of Montana,
with offices at 411 East Main, Bozeman, Montana 5971 S, GRANTEE, its successors and
assigns, a public access easement for the use of the public, in, through, and across a strip of land
situated in Gallatin County, Montana, of varying width to be located on the following described
real property: The SE '/ of Section 10~,Townsh~ 2 South, Range_5_East, P.M.M., Gallatin
County, Montana.
An easement being of varying width strip lying along the alignment described
below:
Colrlmencing at the Northwest Corner of Tract 2, COS No. J-92-A, SE '/ of
Section 10, Township 2 South, Range S East, F.M.M., S89°34' 19"E, a distance of
38.Ei4 feet to the True Point of Beginning (P.O.B.);
Thence S69°3S'27"E a distance of 54.75 feet, thence S89°36' 12"E a distance of
41 Ei.55 feet, thence N66°31' 14"E a distance of 45.61 feet, thence N89°34' 19"W a
distance of 19.74 feet, thence S66°31' 14"W a distance of 20.93 feet, thence
N89°35' 14"W a distance of 424.43 feet, thence N69°44'21"W a distance of 25.33
feet, thence N89°34' 19"W a distance of 22.57 feet to the end of said easement,
containing 0.110 acres, more or less.
The easement is more particularly described on the attached Exhibit A which by this
reference is Ixlade a part hereof.
The GRANTOR states that he possesses the real property described above and that he has
a lawful right to ~n-ant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein 1,~-anted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors, and assigns of the
parties hereto.
