SUBJECT: 2008 Curbing and Sidewalk Impravements -Contract Award
MEETING DATE: May l9, 2008 (Consent Agenda)
RECOMMENDATION: Authorize the City Manager to sign the Notice of Award to award the
contract for the 2008 Curbing and Sidewalk Impravements, Schedules 1 and 2, to Knife River,
Inc. in the amount of $ l 08,179.85.
BACKGROUND: Bids were opened May 13, 2008, far the 2008 Curbing and Sidewalk
Improvement project. The project consists of curb replacement in the 600 and 700 blocks of S.
9t" Avenue and in the 800 block of W. Alderson Street. A good portion of the curb replacement
will be adjacent to Irving School, and new ADA ramps will be installed at the intersections of
College and 9t", Alderson and 9t", and Dickerson and 9~". In addition, the work includes
installation of sidewalks along vacant Tats in Bridger Creek Subdivision Phase 3 (St. Andrews
Drive, Turnberry Court, and Caddie Court). A condition of plat approval was that all sidewalks
shall be installed within three years of plat recordation, which was April 2000. The
1-Iomeowners Association requested that we enforce this condition. Letters were sent in
December of 2006 to all property owners of vacant lots advising them that they needed to get the
sidewalks installed by October 2007 or the sidewalks would be installed for them at their
expense. Ten out of the 38 lots remain without sidewalks. Four bids were received, with the low
bidder being Knife River, Inc. of Belgrade, MT in the amount of $105,179.85, Total Base Bid.
The bids appear to be competitive with the low bid being approximately 26% below the
construction estimate ($143,750.37). A copy of the Certified Bid Tabulation is attached.
FISCAL EFFECTS: The work has been broken into two schedules. Schedule 1 is for
installation of sidewalks in Bridger Creek Subdivision Phase 3, with a base bid amount of
$26,604.60. The cost of this work would be billed back to the property owners. Schedule 2 is for
the curb replacement work, with a base bid amount of $78,575.25. Funding for this work would
be from the Gas Tax Fund.

Yau are the apparent Successful Bidder and have been awarded a Contract for installation of new
concrete sidewalks, and replacement of concrete curbing and drive approaches The Contract
Price of your Contract is: one hundred five thousand one hundred seventy nine and 85!100
Dollars ($105,179.85}.
Three copies of the proposed Contract Documents accompany this Notice of Award.
You must comply with the following conditions precedent within fifteen (15) days of the date
of this Notice of Award, that is, by _____
You must deliver to the OWNER 3 fully executed counterparts of the Agreement including
all the Contract Documents and Drawings.
2. You must deliver with the executed Agreement the Contract Security (Bonds) as specified in
the Instruction to Bidders (page 8), General Conditions (paragraph 5.01) and Supplementary
Conditions (paragraph SC-5.02).
3. List other conditions precedent:
You must deliver with the executed Agreement the Certificates of Insurance as specified in
the General Conditions (paragraph 5.03}.
Failure to comply with these conditions within the time specified will entitle OWNER to
consider your Bid abandoned, to annul this Notice of Award, and to declare your Bid Security
forfeited.
Within ten (10) days after you comply with these conditions, OWNER will return to you one
fully signed counterpart of the Agreement with the Cmtract Documents attached.
