PUBLIC ACCESS EASEMENT
WHEREAS KENNETH B. WIEGAND and BRUCE H. WIEGAND, Trustees of
the ROY V. WIEGAND FAMILY TRUST da~ed December 18, 2000 and KENNETH
B. WIEGAND and BRUCE H. WIEGAND, Trustees of the VERA M. WIEGAND
TRUST dated February 26, 1998 are the owners of the following
described real property:
Lot 1A of trle Amended Plat~ of Lots 1 and 2, Block 4, Kirk
Subdivision and Lot JA, Block 4, of Amended Plat of Lot
3, Block 4 Kirk Subdivision, located in the SE:!,.;j of
Sect ion :], Township 2 SeJutl'l, Range 5 Ea,st, P. Ivl. M. ,
Gallatin County, Montana, according to the off~cial plat
thereof en file and of record in the office of the County
Clerk and Recorder of Gallatin County, Montana [Plat F-l-
C]
WHEREAS under the terms of that certain Declaration for the
Pineview Condominiums recorded on February 24, 2005 as Document No.
2179463 in the office of the County Clerk and Recorder of Gallatin
County, Montana (" Declaratlc,n") and the By.iaws cf the Association
of Unit Owners of Fineview Condominiums recorded with said
Declaration, Brdce P. Wiegand and Kenne,:h B. Wieqand present ly
serve as the Board of Directors of the Association of Unit Owners
of pireview Condominiums.
WHEREAS the Declaration provide3 o~ page 10, in Article IV,
subsection g, that U1e wr-itten consent of two-thirds of the
aggregate interest of the Unit Owners of Plneview Condominium is
necessary to pI ace an easement on the Common Elements of the
Pin,:~view Condomlnlurn.
WHEREAS, the following unit owners represent at least two-
thirds of the aggregate interest of the Unit Owner& in the Pine
Vi ew Condomlni urns: MICHAE-;:', E. IJIAIER:LE and K.Z\I'HLEEN R. MAIERLE;

WHEREAS the aforementioned unit owners have consented to the
placement of an easement on the Common Elements of Pineview
Condominium as evidenced by the document attached hereto as Exhibit
"B".
COMES NOW KENNETH B. WIEGAND and BRUCE H. WIEGAND, Trustees of
the ROY V. WIEGAND FAMILY TRUST dated December 18, 2000 and KENNETH
B. WIEGAND and BRUCE H. WIEGAND, Trustees of the VERA M. WIEGAND
TRUST dated February 26, 1998 and the Association of Unit Owners of
Pineview Condominiums ( collectively "GRANTORS") and hereby grant an
easement to the City of Bozeman, a Municipal Corporation of the
State of Montana, with office at 411 East Main, with a mailing
address of P.O. Box 1230, Bozeman, Montana 59771-1230 ("GRANTEE")
a public access easement for a sidewalk for the use of the public
in, through, and across a 5.00 foot wide strip of land situated in
Gallatin County, Montana, which is located on the following
described real property:
Lot lA of the Amended Plat of Lots 1 and 2, Block 4, Kirk
Subdivision and Lot 3A, Block 4, of Amended Plat of Lot
3, Block 4 Kirk Subdivision, located in the SE~ of
Section 11, Township 2 South, Range 5 East, P.M.M.,
Gallatin County, Montana, according to the official plat
thereof on file and of record in the office of the County
Clerk and Recorder of Gallatin County, Montana [Plat F-1-
C]
The Common Elements of the Pineview Condominiums, the
Declaration for which was recorded on February 24, 2005
as Document No. 2179463, and as subsequently amended,
said Common Elements being appurtenant to Units 1, 2, 3,
4, 5, 6, 7 and 8 of the Pineview Condominiums, situated
on Lots 8 and 9 in Block 3 of Kirk Subdivision to the
City of Bozeman, Gallatin County, Montana, according to
the official plat thereof on file and of record in the
office of the County Clerk and Recorder of Gallatin
County, Montana.
Said easement is the east
Pineview Condominiums and
particularly described
incorporated herein.
5.00 feet of said Common Elements of the
the east 5.00 feet of said Lot lA as more
on Exhibit "A" attached hereto and
GRANTORS agree:
(1) To construct and maintain the sidewalk at their own expense in

accordance with relevant City Ordinances, including, but not
limited to, snow removal and all major and minor repair work.
(2) To allow the City to make any and all inspections of the
sidewalk and land appurtenant thereto as the City reasonably
deems necessary.
GRANTORS warrant that they have the lawful right to convey the
property, or any part of it, and that they will forever defend the
title to this property against the claims of all persons.
GRANTORS further agree that the GRANTEE may peaceably hold and
enjoy the rights and privileges herein granted without any
interruption by the GRANTORS. The terms covenants and provisions of
this easement shall extend to and be binding upon the heirs,
executors, administrators, personal representatives, successors and
assigns of the parties hereto.
