WIEGAND TRUST dated February 26, 1998 and the Association of Unit Owners of Pineview Condominiums ( collectively "GRANTORS") and hereby grant an easement to the City of Bozeman, a Municipal Corporation of the State of Montana, with office at 411 East Main, with a mailing address of P.O. Box 1230, Bozeman, Montana 59771-1230 ("GRANTEE") a public access easement for a sidewalk for the use of the public in, through, and across a 5.00 foot wide strip of land situated in Gallatin County, Montana, which is located on the following described real property: Lot lA of the Amended Plat of Lots 1 and 2, Block 4, Kirk Subdivision and Lot 3A, Block 4, of Amended Plat of Lot 3, Block 4 Kirk Subdivision, located in the SE~ of Section 11, Township 2 South, Range 5 East, P.M.M., Gallatin County, Montana, according to the official plat thereof on file and of record in the office of the County Clerk and Recorder of Gallatin County, Montana [Plat F-1- C] The Common Elements of the Pineview Condominiums, the Declaration for which was recorded on February 24, 2005 as Document No. 2179463, and as subsequently amended, said Common Elements being appurtenant to Units 1, 2, 3, 4, 5, 6, 7 and 8 of the Pineview Condominiums, situated on Lots 8 and 9 in Block 3 of Kirk Subdivision to the City of Bozeman, Gallatin County, Montana, according to the official plat thereof on file and of record in the office of the County Clerk and Recorder of Gallatin County, Montana. GRANTORS warrant that they have the lawful right to convey the property, or any part of it, and that they will forever defend the title to this property against the claims of all persons. GRANTORS further agree that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTORS. The terms covenants and provisions of this easement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors and assigns of the parties hereto.
