HomeMy WebLinkAboutResolution 2507 Intent to annex Felska/Solvie Convention Center site, Oak Street, 4.01 acres -- ! .~ COMMISSION RESOLUTION NO. 2507 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, THE IN- HABITANTS THEREOF AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DE- SCRIBED, TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACT WITHIN THE CORPORATE LIMITS THEREOF. WHEREAS, there has been presented to the City Commission of the City of Bozeman a written and verbal request petitioning the City Commission to extend the boundaries of the City of Bozeman so as to include a certain contiguous tract of land within the boundaries of the City of Bozeman, which contiguous tract is or will be the subject of a filed plat(s) or certificate(s) of survey; and WHEREAS, the proper legal description of said contiguous tract located in the County of Gallatin, State of Montana, is as follows: Oak Street Annexation (Felska I Solvie convention center site) A parcel of land located in the East quarter of Section 1, Township 2 South, Range 5 East, Montana Principal Meridian, and more particularly described as follows: Commencing at the East quarter corner of Section 1, T2S, R5E, MPM, Gallatin County, Montana, thence North 88000100" West a distance of 745.60 feet; thence North 1010120" East a distance of 30.00 feet to the point of beginning; thence North 88000'00" West a distance of 370.20 feet; thence North 1016130" East a distance of 469.43 feet; thence North 88043130" East a distance of 369.66 feet; thence South 1012146" West a distance of 474.13 feet to the point of beginning. Said tract contains 4.01 acres. WHEREAS, the provision of services to said contiguous tract will be the subject of a mutual agreement between the City and the freeholders of the tract; and WHEREAS, it will be to the best interests of the City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tract hereinbefore described to extend the boundaries of the City of Bozeman so as to include the said contiguous tract herein- before described within the corporate limits of the said City of Bozeman. ( -' NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1 That it is hereby declared, subject to the condition that the provision of services to the contiguous tract hereinbefore described will be the subject of a mutual agreement between the City of Bozeman and the freeholders of the tract, that it is in the best interests of the City of Bozeman and the inhabitants thereof and of the inhabitants of said contiguous tract that the boundaries of the said City of Bozeman be extenden so as to include the contiguous tract hereinbefore described within the boundaries and corporate limits of the City of Bozeman, Montana. Section 2 Pursuant to Section 7-2-4312, M.C.A., the Clerk of the City Commission shall cause notice to be published in the Bozeman Daily Chronicle, a newspaper nearest the parcel of land to be embraced within the corporate limits and boundaries of the City of Bozeman, at least once a week for two successive weeks, which notice shall be to the effect that such Resolution has been duly and legally passed and that for a period of twenty days after the first publication of such notice, the Clerk of the City Commission will receive expressions of approval or disapproval in writing as to the proposed extension of the boundaries of the City of Bozeman from resident freeholders of the territories to be embraced. PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 4th day of June 1984. Said Resolution is entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, THE INHABITANTS THEREOF AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED, TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO I NCLUDE THE SAID CONTIGUOUS TRACT WITH IN THE CORPORATE LIMITS THEREOF. The real property proposed for annexation is located in the East quarter of Section 1, Township 2 South, Range 5 East, Montana Principal Meridian, and is known as the Felska/Solvie Annexation, and is more particularly described as follows, to wit: Oak Street Annexation A parcel of land located in the East quarter of Section 1, Township 2 South, Range 5 East, Montana Principal Meridian, and more particularly described as follows: Commencing at the East quarter corner of Section 1, T2S, R5E, MPM, Gallatin County, Montana, thence North 88000'00" West a distance of 745.60 feet; thence North 1010120" East a distance of 30.00 feet to the point of beginning; thence North 88000.00" West a distance of 370.20 feet; thence North 1016130" East a distance of 469.43 feet; thence North 88043'30" East a distance of 369.66 feet; thence South 1012146" West a distance of 474.13 feet to the point of beginning. For a period of twenty (20) days following the first publication of this Notice, the Clerk of the Commission will receive expressions, in writing, of approval or disapproval of the proposed extensions of the boundaries of the City of Boeman from the freeholders of the tract proposed to be annexed.
