A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF
BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT NO. 646
FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF A
SANITARY SEWER AND WATER MAIN TO SERVE THE ADJOINING PROP-
ERTIES, MORE SPECIFICALLY DESCRIBED AS FOLLOWS: AN 8
INCH WATER MAIN AND APPURTENANCES AND AN 8 INCH SANITARY
SEWER AND APPURTENANCES.
THE CONSTRUCTION AND INSTALLATION OF THE SANITARY SEWER
AND WATER MAIN TO INCLUDE ALL TRENCH EXCAVATION AND BACK-
FILL, BEDDING MATERIAL, SANITARY' SEWER LINES, DUCTILE IRON
WATER MAIN, MANHOLES, VALVES, FITTINGS, HYDRANTS, SERVICE
LINE STUBS AND OTHER NECE5SARY A~PU~TENANCES.
WHEREAS, there has been filed with. the Clerk of the City conunission of
the City of Bozeman, Montana, ~ petition in due torm of certain owners of
property situated within the boundaries of Special Improvement District No. 646
as hereinafter more specifically described, aSking that a special improvement
district be created for the purpose of constructing and installing sanitary
sewer and water mains to provide service to lots within the district; and
WHEREAS, at a regular meeting of the City conunission of the City of
Bozeman held on the 23rd day' of April 1984, the aforesaid petition was respec-
tively considered.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA:

Section 1
Declaration otLntention
That it is hereby declared to be the intention of the City of Bozeman
to create a special improvement district to be known and designated as Special
Improvement District No. 646 of the City of Bozeman for the purpose of con-
structing and installing sanitary sewers and water mains, said project to
include all appurtenant work for the construction and installation of sanitary
sewers and water mains to provide servtce to all lots within the district.
Section 2
Boundaries
The boundaries of said Special Improvement District No. 646 are described
as follows:

A tract of land being Lots 14, 15, 16, 17, 18, 19 and 19A,
of the Gordon Mandeville State School Section Subdivision
as filed and of record with the Clerk and Recorder, Gallatin
County, Montana, and located in the Southeast One-Quarter of
Section 36, Township 1 South, Range 5 East, M.P.M., Gallatin
County, Montana; being further described as follows:
Beginning at the intersection of the south line of said
Southeast One-Quarter with the Easterly right-of-way on U.S.
Highway 10 (North Seventh Avenue) said point being South
89 08'00" West a distance of 1270.76 feet from the Southeast

corner of said Section 36, thence North a distance of 43.02
feet to the true point of beginning. Thence North a distance
of 2108.51 feet to a point on the Southwesterly right-of-way
of the Northern Pacific Railroad. Thence South 43 19'30"
East along said railroad right-of-way a distance of 166.68
feet. Thence continuing on said railroad right-of-way along
a 5529.64 fgot radius curve to the right, through a central
angle of 06 00'00", an arc d~stance of 579.06 feet. Thence
continuing along said railroad 1;'ight-of-way S'out8' 37014' 30"
East a distance of 454.00 feet. Thence Nor~h 89 42'00" West
a distance of 198.88 feet. Thence South 00 18'00" West along
the East line 0& said Lot 16 and 17 a distance of 482.28 feet.

Said tract being 19.9410 acres, more or less, along with and
subject to all existing easements.

Character of Improvemen~
The character of the improvements to be made is the installation and
construction of an 8 inch sanitary sewer and an 8 inch water main, including
trench excavation, backfill, bedding material, sanitary sewer lines, ductile
iron water main, manholes, valves, fittings, hydrants, service line stubs
and other necessary appurtenances.
Section 4
Es,tima te of Cost
The total estimated cost of the improvements within the district
including engineering, contingency, special improvement district revolving
fund and incidental expens:es is One Hundred Seventy Thousand and no/lOO Dollars
($170,000.00) .

Method of Assessment
The cost of such improvements is to be assessed against the entire
district. Each lot, block, tract or parcel of land within the district will
be assessed for that portion of the whole cost which its area bears to the
area of the entire district, exclusive of streets, avenues and alleys.
The total actual assessable area within the entire district is 868,613.88
square feet and is the area on which all protests will be received, considered
and determined. It is also the area on which all assessments will be figured.
Section 6
Payments
The payments: for said improvements shall be made in twenty (20) annual
installments extending over a period of nineteen (19) years, but this shall

not be construed to prevent payment in full at any regular payment date by
any property owner who desires to do so. It is proposed to pay the entire
cost and expense of the construction and installation of said improvements
with cash to be obtained from the sale of bonds of said Special Improvement
District No. 646 as authorized by law. Such bonds will be in denominations
of One Hundred Dollars ($100.00) each and fractions or multiples of $100.00
where necessary, to be issued and chargeable against a fund known and desig-
nated as Special Improvement Dtstrict No. 646 Fund of th.e City of Bozeman.
The bonds will be redeemable at the option of the C.;tty, singly or in multiples,
and in the order of their registration, from whatever funds are available
for the purpose in said Special Improvement D~strict No. 646. Said bonds
shall draw a simple interest from t:.he date of their registration until called
for payment, which interest shall be chargeable as part of the cost of con-
struction and installation of said improvements. The bonds will be issued
and sold in accordance with the prov.$:.sions of Section 7-12-4201 and Section
7-12-4223, M.C.A., and all other applicable provisions of Title 7, M.C.A.,
relating to special improvement districts and cities and tOwn;3, and any
amendments thereof.

Section 7
Protests and Notices
That the regular sess'ion of the City commission of the City of Bozeman,
to be held at the Commission Chamber, city Hall, Bozeman, Montana, on Monday,
the 18th day of June, 1984, at the hour of 7:00 otclock p.m. of said day, is
the time and place, when and where the City commission will hear and pass
upon all protests duly and regUlarly made and filed against the creation of
said Special Improvement District No. 646, the improvements proposed to be
made pursuant thereto and the extent and character thereof, or either of them;
and the Clerk of the City commission be, and she is hereby directed to give
notice in the manner and for the time as by law required, of the adoption of
this resolution of intention.
ADOPTED by the Corrunission of the City of Bozeman, Montana, at a regular
and stated session of said Commission held on the 14th day of May 1984.

NOTICE is hereby given that on the 14th day of May 1984 at a

at 7:00 o'clock p.m. at the Commission ROom of the City Hall, 411 East Main
Street, Bozeman, Montana, is designated as the t~e and place for hearing
objections to the action proposed to construct and install a sanitary sewer
and water main upon the following described contiguous territories within
the corporate limits of the City of Bozeman, Monta.na. Expressions of

approval or disapproval by resident freeholders of the territories proposed
to be constructed and installed upon must be made in writing and filed with
the Clerk of the City Commission of the City of Bozeman not later than
fifteen (15) days after the date of the first publication of this notice.
A description of the boundaries of the territories proposed to be
constructed and installed upon by said Commission Resolution No. 2499 is
as follows:
