COMMISSION RESOLUTION NO. 2487
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF BOZEMAN, MONTANA AUTHORIZING THE CITY
MANAGER AND THE DIRECTOR OF FINANCE TO ORDER
ASSESSMENTS DECLARED DELINQUENT PURSUANT TO
SECTION 7-12-4183(2), MCA, TO BE WITHDRAWN FROM
THE COUNTY TREASURER.
WHEREAS. by authority of Section 7-12-4183(2), MCA, the City Commis-
sion may. by appropriate resolution, declare all payments of subsequent
installments of a special assessment delinquent when the payment of anyone
installment of any special assessment becomes delinquent; and
WHEREAS, Section 7-12-4184 MCA provides that whenever any special
assessment or installment is declared delinquent and is certified to the County
Treasurer for collection, the City Commission may order the delinquent assess-
ment to be withdrawn from the County Treasurer and reinstated in the office
of the Di rector of Finance upon payment of the assessment or the installment
and interest up to date; and
WHEREAS, a timely and effective method to provide for reinstatement is
desi red.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOZEMAN, MONTANA:
Section 1
That when the payment of one installment of any special assessment
becomes delinquent and all other payments of subsequent installments are
declared, by appropriate resolution of the City Commission, to be del inquent,
and the same are certified to the County Treasurer for collection, the City
Manager and the Director of Finance may provide written notice to the County
Treasurer, which notice shall constitute authority for the County Treasurer
to cancel and withdraw the delinquent special assessment or installment for
each designated parcel or tract of land. This notice shall be provided to the
County Treasurer only upon payment to the Director of Finance of the assess-
ment or the installment and interest up to date.

Section 2
Payments may be accepted through the date of October 15 of each year.
However, no payment of a delinquent installment or installments and interest
shall be accepted by the Director of Finance between the dates of October 16
and October 31, inclusive, of any year.
Section 3
In order to reinstate a special assessment, all regularly scheduled install-
ments must be paid, along with interest up to date, to bring the special
assessment to current billing status as described in the resolution of intent to
create the relevant special improvement district.
Section 4
After each notice has been given to the County Treasurer, the Director
of Finance shall reinstate the special assessment upon the special assessment
records of the City of Bozeman, and restore them to regular bi lling status, as
specified by the resolution creating the particular special improvement
district.
Section 5
The withdrawal and reinstatement may be made at any time before or
after sale of the parcel or tract of land for delinquent taxes and before a tax
deed therefore is executed.
Section 6
This resolution shall become effective upon passage.
PASSED AND ADOPTED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN , MONTANA, at its regular session held on the 24th day of
October, 1983.
