COMMISSION RESOLUTION NO. 2473
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF BOZEMAN, MONTANA, TO SUBMIT TO THE QUALIFIED
ELECTORS OF THE CITY OF BOZEMAN, AS TO WHETHER
TO ENACT AN ORDINANCE REQUIRING VOTER APPROVAL
OF LOCAL OPTION TAXES.
WHEREAS, the City of Bozeman is asking the electors
to grant the Commission-Manager form of government
self-government powers at the November 8, 1983 general
election for municipal officials: and
WHEREAS, a city with self-government powers is
prohibited the exercise of the power to authorize a tax on
income or the sale of goods or services except that it shall
not be construed to limit the authority of local government
to levy any other tax or establish the rate of any other
tax: and
WHEREAS, a city with self-government powers could
impose such other taxes which could not be imposed by a
City with general government powers: and
WHEREAS, it is desirable to submit the question of
enacting such taxes to the electorate.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOZEMAN, AS FOLLOWS:
Section 1
That there shall be submitted to the qualified electors
from the City of Bozeman, Montana, in an election to be held
on the 8th day of November, 1983, a question of whether to
enact an ordinance requiring that any new tax be submitted
to the voters and receive an affirmative vote of a majority
of the electors voting on the question.
Section 2
The term "new tax" shall mean any tax which cities with
general government powers are not authorized by state law to
enact.

Section 3
The statement of implication to be placed on the ballot
shall be in a manner similar to the following example:
D
FOR the City of Bozeman enacting
an ordinance requiring voter approval
of any new tax.
D
AGAINST the City of Bozeman enacting
an ordinance requiring voter approval
of any new tax.
Section 4
That if the qualified electors grant self-government
powers to the City of Bozeman and ratify this referendum the
City Commission shall adopt an ordinance requiring voter
approval of such taxes.
