COMMISSION RESOLUTION NO. 2456
A RESOLUTION OF THE CITY OF BOZEMAN ESTABLISHING A
FEE OF $1,200.00 AS THE CASH-IN-LIEU PAYMENT OPTION
TO THE OFF-STREET PARKING REQUIREMENT UNDER THE
ZONING TITLE OF THE BOZEMAN MUNICIPAL CODE.
WHEREAS, the Bozeman City Commission has enacted an Ordinance No.
1027, the Zoning Ordinance, allowing a payment of cash in lieu of certain park-
ing requi rements; and,
WHEREAS, said Ordinance provides that the specific amount of cash to
be paid in lieu of the parking requirements shall be set from time to time by
resolution of the City Commission.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOZEMAN:
Section 1
That until further action by the City Commission, the required amount of
cash in lieu to be paid for each off-street parking stall required by the City of
Bozeman parking requirements shall be $1,200.00.
Section 2
That the total amount owed for cash-in-lieu shall be paid as follows:
(1) Payment of the total amount in cash on or before the issuance of
the building permit; or
(2) Payment of six hundred dollars ($600.00) or one-tenth (1/10) of the
total amount, whichever is greater, plus a three percent (3%) admin-
istrative charge on the total amount on or before the issuance of
the bui Iding permit; and
A like payment of six hundred dollars ($600.00) or one-tenth (1/10)
of the total amount, whichever is greater, plus interest on the de-
clining principal balance at the rate of eight percent (8%) per year
on or before the date one year after the date of issuance and a like
sum each successive year thereafter until the entire remaining princi-
pal balance plus accrued interest shall be paid in full.
In no event shall the payment of such total amount extend for a period
in excess of ten (10) years.
Section 3
No person who is participating in such a payment plan may be issued an
annual business license unless such payments are current.

Section 4
That the cash in lieu fee may be revised at the discretion of the City
Commission, but shall be reviewed approximately the first day of May of each
year.
