COMMISSION RESOLUTION NO. 2442
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOZEMAN, MONTANA, ENCOURAGING THE
GALLATIN COUNTY COMMISSION TO CREATE A
REFUSE DISPOSAL DISTRICT UNDER THE PROVI-
SIONS OF SECTIONS 7-13-201 THROUGH 7-13-243,
MCA, ENCOMPASSING THE CITY OF BOZEMAN AND
THE RURAL AREAS SURROUNDING THE CITY OF
BOZEMAN.
WHEREAS, the State of Montana, in Section 7-13-201,
MCA, states findings and purpose for Refuse Disposal
Districts: "(1) The improper storage, collection and
disposal of refuse is hereby declared to be a significant
hazard to the health, safety, and welfare of Montana
citizens and can cause the spread of disease, air pollution,
and water pollution. Refuse can be an excellent habitat
for disease vectors such as rats and insects: (2) There-
fore, it is deemed necessary to provide for the creation
of refuse districts to control storage, collection, and
disposal of refuse:" and
WHEREAS, cities and towns may be included in a county
refuse disposal district if approved by the city or town
council: and
WHEREAS, the city of Bozeman now owns and operates a
landfill for disposal of refuse serving a geographic area
extending greatly beyond its corporate boundaries: and
WHEREAS, the estimated future life span at the City of
Bozeman landfill is estimated to be 10 to 13 years at
maximum: and
WHEREAS, potential ground water contamination could
shorten the estimated life-span of the city landfill: and
WHEREAS, the City does not have the authority to tax
for services beyond its corporate boundaries: and
WHEREAS, the population in the rural Bozeman area
continues to grow more rapidly than within the city: and

WHEREAS, the volume of refuse created by the ever
increasing population in the Bozeman rural area is considered
to be a Gallatin County, rather than a City of Bozeman,
obligation to plan for future disposition of solid waste;
and
WHEREAS, the present City of Bozeman landfill could be
designated to serve as a Gallatin County Refuse District
disposal site for the lifespan thereof; and
WHEREAS, a created county refuse district could pursue
future disposition of solid waste through landfill or
incineration; and
WHEREAS, the City of Bozeman desires to cooperatively
seek solutions to problems and situations involving the
total community of Bozeman, not just the area within its
corporate boundaries; and
WHEREAS, Section 7-13-203, MCA, grants authorization
to create refuse disposal districts to the County Commissioners.
NOW, THEREFORE, BE IT RESOLVED that the City Commission

of the City of Bozeman encourages the Commissioners of Gallatin

County to pass a resolution of intention to create a refuse
disposal district encompassing the City of Bozeman and the
surrounding rural areas of Gallatin County that, at the dis-
cretion of the County Commissioners, would best serve the
existing and future needs for storage, collection and disposal
of solid waste.
PASSED AND ADOPTED BY THE CITY COMMISSION of the City of
Bozeman at a regular and stated session of said City Commission,
held on the 13m day of
