COMMISSION RESOLUTION NO. 2428
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
RELEVYING AND REASSESSING A SPECIAL ASSESSMENT OF T AXES UPON
CERT AIN PROPERTY IN THE CITY OF BOZEMAN, COUNTY OF GALLA TIN,
STATE OF MONTANA, TO DEFRAY THE COST OF CONSTRUCTING AND
INSTALLING MISCELLANEOUS SIDEWALKS AND CURBS DURING THE YEAR
1978.
WHEREAS, the Commission of the City of Bozeman, pursuant to the provisions of
Section 7-12-4176, MCA 1979, levied and assessed a special assessment tax upon certain prop-
erties in the City of Bozeman for sidewalk and curb improvements by Commission Resolution
No. 2149, dated December 5, 1979; and
WHEREAS, the Commission of the City of Bozeman, on August 23, 1982, agreed to
abate delinquent special improvement taxes levied for the 1978 Walk and Curb Improvement
Program, along with all penalties and interest accrued, against the property owned by David
M. and Nancy K. Ward, at 716 South 13th Street, in the City of Bozeman; and
WHEREAS, the Commission also agreed to relevy and reassess the original assessment,
at the original interest rate of 8.45 percent per annum, over the original life of the district,
which was five years, in October, 1982.
NOW, THEREFORE, pursuant to provisions of Section 7-12-4186, MCA, 1979,
BE IT RESOLVED AND IT IS HEREBY ORDERED BY THE COMMISSION OF THE CITY
OF BOZEMAN:
Section 1
That to defray the cost of constructing and installing sidewalks and curbs under the
1978 Miscellaneous Sidewalk and Curb Program, for the particular piece of property known as
713 South 13th Avenue, there is hereby levied and assessed a tax amounting to $612.45.
Section 2
That the sum so assessed be levied and assessed upon said parcel of land; that the
sum be collected from the respective owner as required by law; that the payment of such sum
shall be made in five (5) installments; that the payment of such installments shall be made on
or before the 30th day of November or each year until payment of all installments, together
with interest thereon, shall be made; that said sum shall be paid and the collection thereof
shall be made in the manner and in accordance with the law governing the collection of Special
Improvement Taxes; that failure to pay such assessments when the sum shall become due and
payable shall make such persons and said parcel of land liable to the penalties provided by
law relative to delinquent taxes.

Section 3
That the regular session of the Commission of the City of Bozeman to be held in the
Commission Chamber in the City Hall Building of said City on the 20th day of September, 1982,
at 7 o'clock p.m. be, and the same is hereby designated as the time and place at which objec-
tions to the final adoption of this resolution will be heard by said Commission.
Section 4
That the Clerk of the Commission of the City of Bozeman be, and she is hereby
ordered and directed to publish in the said City of Bozeman, a notice signed by the Clerk of
the Commission and stating that a resolution relevying and reassessing a special assessment of
taxes to defray the cost and expense of constructing and installing sidewalks and curbs in the
City of Bozeman for the year 1978 is on file in the office of the Clerk of the Commission, sub-
ject to inspection for a period of five (5) days, that said Notice shall state the time and place
at which objections will be heard by the Commission to the final adoption of this Resolution; that
it shall be published at least five (5) days before the date set by the Commission for the hearing
of objections and the final adoption of this Resolution.
Provisionally passed and adopted by the Commission of the City of Bozeman at a regu-
lar session thereof, held on the 7th day of September 1982.

1978.
NOTICE IS HEREB Y GIVEN, that at a regular session of the Commission of the City
of Bozeman held on the 7th day of September 1982, Commission Resolution No. 2428 was pro-
visionally passed and adopted; that said Resolution relevies and reassesses a special assessment
of taxes upon certain property located at 713 South Thirteenth Avenue in the City of Bozeman,
County of Gallatin, State of Montana, to defray the cost of constructing and installing miscel-
lanous sidewalks and curbs during the year 1978.
NOTICE IS HEREBY FURTHER GIVEN, That said Commission Resolution No. 2428 is
now on file in the office of the Clerk of the Commission of the City of Bozeman, subject to
inspection of all persons interested, for a period of five (5) days; that Monday, the 20th day
of September 1982, at 7:00 p.m. of said day at the regular session of the Commission of the
City of Bozeman, in the Commission Room, in the City Hall Building, has been designated as
the time and place when and where said Commission will hear and pass upon any and all ob-

jections that may be made to the final passage and adoption of said Commission Resolution No.
2428 and the relevying and reassessing of said assessment; and that said Resolution will be

finally passed and adopted at said regular session of said Commission, subject to such correc-
tions and amendments that may be made upon objections made and filed with the Clerk of the
Commission within five (5) days limit as provided by law.
