COMMISSION RESOLUTION NO. 2403 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO ESTABLISH A REVISED LANDFILL FEE SCHEDULE FOR USERS OF THE CITY OF BOZEMAN'S LANDFILL. WHEREAS, the City Commission passed Resolution No. 2361, on November 4, 1981, which increased residential garbage rates and landfill fees by 25 percent over prior years' fees, and which provided for the elimination of an annual landfill assessment, effective July 1, 1982; and WHEREAS, a fair and equitable operation of the enterprise fund requires user fees to be paid by the recipients of the benefit of landfill use; and WHEREAS, the Commission recognizes the need for integrated, effective management of the garbage and landfill operation, which operation is currently being developed by staff; and WHEREAS, the Commission also recognizes the need for interim gate fees until such study is finalized; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: 1. That upon application of the City Manager and the Director of Finance and their appropriate staff, the City Commission shall conduct a public hearing to be held in the City Commission Room located in the basement of the City Hall, 411 East Main Street, Bozeman, Montana, at 7:00 p.m. on the 19th day of July, 1982. 2. The purpose of the public hearing is to hear testimony in support of and opposition to the proposed rate increase sought by the City staff of the City of Bozeman. The proposed rates, if adopted, will be effective September 1, 1982. 3. That the following schedule of landfill fees is hereby established, with the intent of future revision and possible increase, as cost analyses are finalized by City staff: ~ Load Size Passenger cars Pickups--base rate for liquid box level plus $.75/yard for excess Pickup base rates: 112 ton and smaller 1/2-3/4 ton 1- 2 ton 2 ton and over Large tree stumps, trunks Dead Animals Small (sheep, goats, pigs, calves, etc. Large (cows, horses, all over 400 lbs.) The Clerk of the City Commission is instructed to advertise a notice of said hearing together with its purpose once a week for two (2) consecutive weeks in the Bozeman Daily Chronicle with the last publication no later than July 14, 1982.
