COMMISSION RESOLUTION NO. 2399
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOZEMAN TO CONDEMN A TRACT OF LAND
LOCATED IN SECTIONS 25, 31 and 36 OF TOWN-
SHIP 1 SOUTH, RANGE 5 EAST, AND SECTION 31
TOWNSHIP 1 SOUTH, RANGE 6 EAST, M.P.M.
GALLATIN COUNTY, MONTANA FOR THE PURPOSE OF
CONSTRUCTION, OPERATION AND MAINTENANCE OF
A SEWER LINE.
WIT N E SSE T H :
WHEREAS, Burlington Northern, Inc., on or about July
21, 1969 granted to the City of Bozeman a permit to construct a
er
twenty (20) inch sanitar~ipeline over, across and under their
right-of-way located on the above described real property; and
WHEREAS, the City of Bozeman and the engineers of the
City of Bozeman and their consulting engineers find it necessary
to construct a sewer line through and under the above described
real property owned by Burlington Northern, Inc. and a request for
a permit to construct the same having been denied; and
WHEREAS, the City Commission of the City of Bozeman
heard testimony in support of the need by the customers of the City
of Bozeman for the additional sewer line and the Commission having
knowledge of the Order of the Honorable W. D. Murray, United States
Federal Judge, to construct additional municipal waste water
treatment facilities;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOZEMAN:

That the City of Bozeman commence immediately to con-
struct an additional sewage and sanitary sewer pipeline upon, over
and underneath the following described real property:
Beginning at a point on the northerly railroad
righ~of-way line, said point being 200 feet
northeasterly of Railroad Station 7479+93.5;
thence North 68032'09" West, along the centerline
of the proposed sanitary sewer line, a distance
of 261.8 feet to Sanitary Sewer Junction Structure
No.3 at Sanitary Sewer Station 103+80, said
station being 71.0 feet northeasterly of Railroad
Station 7482+16.2, all of which lies within the

Southeast Quarter of Section 36, Township
1 South, Range 5 East, and the Southwest
Quarter of Section 31, Township 1 South,
Range 6 East, M.P.M. Gallatin County, Montana.
Beginning at Junction Structure No. 2 which
is Sanitary Sewer Station 72+75, said Station
is 221.4 feet northeasterly from Railroad
Station 7510+93.7; thence North 81057'11"
West, along the centerline of the proposed
sewer, a distance of 17.0 feet to Manhole No.
9 of the proposed sanitary sewer at Sanitary
Sewer Station 72+50, said manhole is 211.3 feet
northeasterly from Railroad Station 7511+06.6;
thence North 53152'50" West, along the proposed
sanitary sewer centerline, a distance of 3321.8
feet, to Manhole No. 1 of the proposed sanitary
sewer at Sanitary Sewer Station 40+00, said
station is 168.0 feet northeasterly from Railroad
Station 7544+07; thence North 45036'17" West,
along the centerline of proposed sewer, a distance
of 55.6 feet to Junction Structure No.1 of the
proposed sanitary sewer at Sanitary Sewer Station
39+55, said station is 176.0 feet northeasterly
of Railroad Station 7544+62, all of which lies
within the Northwest Quarter and the Northeast
Quarter of Section 36, Township 1 South, Range
5 East and the Southwest Quarter of Section 25,
Township 1 South, Range 5 East, M.F.M. Gallatin
County, Montana.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, this 17th day of
