COMMISSION RESOLUTION NO. 2396
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONT AN A, DECLARING IT TO BE THE INTENTION OF THE CITY OF
BOZEMAN AND THE INHABIT ANTS THEREOF, AND OF THE INHABIT ANTS
OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN,
KNOWN AS THE NORTH SEVENTH ANNEXATION, AND HEREIN MORE
PARTICULARL Y DESCRIBED, TO EXTEND THE BOUNDARIES OF THE
SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS
TRACTS WITHIN THE CORPORATE LIMITS THEREOF.
WHEREAS, there has been presented to the City Commission of the City of Bozeman
a Petition requesting the said City Commission extend the boundaries of the City of Bozeman
so as to include certain contiguous tracts of land within the boundaries of the City of Bozeman,
and having presented to the City of Bozeman certificates of survey of said land; and
WHEREAS, the proper legal description of said contiguous tracts located in the County
of Gallatin, State of Montana, is as follows:
A tract of land being Lots 14, 15, 16, 17, 18 and 19 and a portion of
Griffin Drive of the Gordon Mandeville State School Section Subdivision
and located in the Southeast One-quarter of Section Thirty-six, Town-
ship One South, Range Five East, Montana Principal Meridian, Gallatin
County, Montana; being further described as fol.lows:
Beginning at the intersection of the South line of said Southeast One-
quarter with the Easterly right-of-way on U.S. Highway 10 (North
Seventh Avenue), said point being South 89008'00" West a distance of
1269.17 feet from the Southeast corner of said Section Thirty-six. Thence
North 00018'00" East along said Easterly right-of-way a distance of 2151. 53
feet to a point on the Southwesterly right-of-way of the Northern Pacific
Railroad. Thence South 43019'30" East along said railroad right-of-way a
distance of 166.68 feet. Thence continuing on said railroad right-of-way
along a 5529.65 foot radius curve to the right, through a central angle
of 06000'00", an arc distance of 579.06 feet. Thence continuing on said
railroad right-of-way South 37019'30" East a distance of 454.00 feet.
Thence North 89042'00" West along the South line of said Lot 18 a distance
of 198.88 feet. Thence South 00018'00" West along the East line of said
Lots 16 and 17 a distance of 482.28 feet. Thence South 34022'00" West
along a portion of the West line of said Lot 16 a distance of 82.30 feet.
Thence South 00018'00" East along a portion of the East line of said Lot 16
a distance of 25.00 feet. Thence North 89042'00" West along the South
line of said Lot 16 a distance of 247.35 feet. Thence South 00018'00"
West along the East line of said Lots 14 and 15 and across a portion of
said Griffin Drive a distance of 649.39 feet to a point on said South line
of the Southeast One-quarter of Section Thirty-six. Thence South
89008'00" West along said South line a distance of 276.60 feet to the
Point of Beginning. All as shown on the official plat of said subdivision.
Said tract being 20.10 Acres, more or less, along with and subject to
all existing easements.
WHEREAS, it is in the best interests of the City of Bozeman to conduct a public
hearing to hear testimony and receive evidence in support of and in opposition to the proposed
annexa tion.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN:

Section 1
That the City Commission shall, on the 5th day of April 1982, at 7:00 o'clock p.m.,
in the Commission Chambers, City Hall Building, 411 East Main Street, Bozeman, Montana, hold
a public hearing on the question of annexation of the above-described real property into the
corporate limits of the City of Bozeman.
Section 2
Pursuant to Section 7-2-4708, M.C.A., the Clerk of the City Commission shall cause
notice to be published in the Bozeman Daily Chronicle a public notice fixing the date, hour and
place of the public hearing, and said notice shall describe clearly the boundaries of the area
under consideration, which boundaries are set out in this resolution. and state that the report
required by Section 7-2-4714. M. C. A.. will be available in the Office of the Clerk of the City
Commission at least fourteen (14) days prior to the date of the public hearing.
Section 3
The date of last publication of the notice shall not be more than seven (7) days pre-
ceding the date of the hearing and furthermore the date for such hearing shall not be less than
thirty (30) days and not more than sixty (60) days following the passage of this Resolution.
PASSED AND ADOPTED BY THE CITY COMMISSION at a regular session held on the
1st day of March 1982.
