HomeMy WebLinkAboutResolution 2390 Policy for Acceleration of SID Delinquent Payments ~,~ -- ---=-- -- -~ "'- ., COMMISSION RESOLUTION NO. 2390 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN ESTABLISHING A POLICY FOR THE ACCELERA- TION OF SUBSEQUENT INSTALLMENTS OF SPECIAL ASSESS- MENTS WHEN ANY ONE SPECIAL ASSESSMENT BECOMES DELINQUENT; PROVIDING FOR EXCEPTIONS THERETO AND ESTABLISHING A PROCEDURE FOR GRANTING SUCH EXCEPTIONS. WHEREAS, the delinquency rate on special assessments for improvements financed by Special Improvement Districts has risen in recent years; and WHEREAS, such delinquencies place an unreasonable burden on the taxpayers and citizens of the City of Bozeman; and WHEREAS, the City of Bozeman desires to implement the provisions of Section 7-12-4183, M.C.A. 1981, as enacted and amended; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, M.ONTANA: Section 1 That when one or more than one installment of any special assessment becomes delinquent, all payments of subsequent install- ments shall, at the option of the City Commission and by appropriate resolution duly adopted, become delinquent. Such delinquent special assessment shall be certified to the Clerk and Recorder of Gallatin County and the Treasurer of Gallatin County must collect such delin- quent special assessments and taxes in the same manner and at the same time as said taxes for general, municipal and administrative purposes are collected by him. In case the same are not paid, the whole property shall be sold as in the case of other properties sold for nonpayment of taxes. Section 2 In order to prevent undue and unnecessary financial hard- ship to any individual who own~s real property on which is located a single-family, owner-occupied dwelling, such individual may apply for an exception to the policies of this resolution as contained in Section 3 herein. ./1/" . .. ., .. ... . "" Section 3 That a written request for an exception to this policy may be submitted no later than November 15 of each calendar year. Contained in said written request shall be the following information: 1. Legal land description, addition; i.e. lot, block and .! 2. A list of the special assessments covered in the request; 3. Current installment; 4. Total balance due; 5. Proof of ownership; and 6. General statement regarding the reason for the request. That upon submission of such request the City Commission shall make a thorough investigation into the matter and shall, prior to certification of delinquencies to the County Treasurer of Gallatin County, Montana, make a decision on the request. '.. Thereafter, one copy of the request shall be kept on file . .. in the office of the Director of Finance. If an exception is granted by the City Commission, one copy shall be placed on file with the County Treasurer of Gallatin County, Montana. If an excep- tion is granted by the City Commission, it shall be valid for a period of one (1) year only. Any subsequent request shall be filed and handled in a similar manner as outlined above for each separate assessment.
