HomeMy WebLinkAboutResolution 2360 Creating SID 639 for street improvements: 015 I COMMISSION RESOLUTION NO. 2360 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 639 FOR THE PURPOSE OF THE CONSTRUCTION AND INSTALLATION OF A WATERMAIN, SANITARY SEWER WYES AND APPURTENANCES AND PAVING TO SERVE THE ADJOINING PROPERTIES AND MORE SPECIFICALLY DESCRIBED AS FOLLOWS: A SIX (6) INCH WATER MAIN AND APPURTENANCES TO PLATINUM STREET, FIFTEEN (15) SANITARY SEWER WYES IN THE SAME AREA, AND SERVICE STUBS TO THE PROPERTY LINES, AND PAVING WITH AN ASPHALT CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS AND NECESSARY APPURTENANCES, ALL IN THE CITY OF BOZEMAN, MONTANA. THE CONSTRUCTION AND INSTALLATION OF THE WATERMAIN, SANITARY SEWER WYES AND PAVING TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIAL, DUCTILE IRON WATER- MAIN, VALVES, FITTINGS, HYDRANTS, SANITARY SEWER WYES, SERVICE LINE STUBS, PAVING WITH INTEGRAL CONCRETE CURBS AND GUTTERS, AND OTHER NECESSARY APPURTENANCES. WHEREAS, at a regular session of the City Commission of the City of Bozeman, Montana, held on the 30th day of September, 1981 the said City Commission duly passed Commission Resolution No. 2352, declaring it to be the intention of the said City Commission to create a special improve- ment district to be known and designated as Special Improvement District No. 639 to the said City, for the purpose of constructing and installing a watermain, sanitary sewer wyes and appurtenances to Platinum Street in the City of Bozeman, Montana, together with all trench excavation and backfill, bedding material, ductile iron watermain, valves, fittings, hydrants, sanitary sewer wyes, service line stubs, paving with integral concrete curbs and gutters, and I other necessary appurtenances thereto. The said Commission Resolution No. 2352 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special Improvement District No.639, and the estimated cost of said improvements and methods of asseSSing the same against the property of said district; and WHEREAS, notice of the passage of said Commission Resolution No. 2352 was duly published, as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and published in the City of Bozeman, Montana, and by sending a copy of such notice by U.S. Mail to each person, firm or corporation having property within the proposed district at his or its last known address, upon the same date that such notice was first published as aforesaid, and due proof having been made of the publication and service of said notices; and WHEREAS, within the time provided by law and said published and service notice, there was not sufficient protests against the creation of said proposed Special Improvement District No. 639, and the City Commission was in regular session on the 21st day of October, 1981 at 1:15 o'clock p.m. of said day, at the Commission Chamber in the City Hall Building in the said City of Bozeman, Montana, and the same being the time and place designated in said notice for passing upon all pro- tests, if any, against the proposed work or against the creation or extension of said district, or both or either; and it further appearing that all of the proceedings for the creation of said district have been lawful and regular; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, ~10NTANA: I Section 1 That the said Special Improvement District No. 639 of the City of Bozeman, be, and the same is hereby created, for the purpose of making improvements as in said Commission Resolution No. 2352 and hereinafter described. Section 2 That said special improvements be, and the same are, hereby ordered to be made in Special Improvement District No. 639 as follows: COMMISSION RESOLUTION NO. 2360 01C A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 639 FOR THE PURPOSE OF THE CONSTRUCTION AND INSTALLATION OF A WATERMAIN, SANITARY SEWER WYES AND APPURTENANCES AND PAVING TO SERVE THE ADJOINING PROPERTIES AND MORE SPECIFICALLY DESCRIBED AS FOLLOWS: A SIX (6) INCH WATER MAIN AND APPURTENANCES TO PLATINUM STREET, FIFTEEN (15) SANITARY SEWER WYES IN THE SAME AREA, AND SERVICE STUBS TO THE PROPERTY LINES, AND PAVING WITH AN ASPHALT CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS AND NECESSARY APPURTENANCES, ALL IN THE CITY OF BOZEMAN, MONTANA. THE CONSTRUCTION AND INSTALLATION OF THE WATERMAIN, SANITARY SEWER WYES AND PAVING TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIAL, DUCTILE IRON WATER- MAIN, VALVES, FITTINGS, HYDRANTS, SANITARY SEWER WYES, SERVICE LINE STUBS, PAVING WITH INTEGRAL CONCRETE CURBS AND GUTTERS, AND OTHER NECESSARY APPURTENANCES. Section 3 That the entire cost and expense of maintaining the improvements herein referred to in said Special Improvement District No. 639, shall be assessed against the entire district. Each lot, block, tract or parcel of land within the district will be assessed for that portion of the whole cost which its area bears to the area of the entire district exclusive of streets, avenues, and public places. The total number of feet of assessable footage within the district is 312,329.33 square feet, which is the area on which all assessments will be calculated. Section 4 That any and all construction districts within the same boundaries and serving the same area are hereby declared abandoned and terminated.
