PUBLIC STREET AND UTILITY EASEMENT
Norton Properties, LLC GRANTOR, in consideration of $ 1.00 and for other and valuable considerations,
receipt of which is acknowledged, grants to The City of Bozeman, a municipal corporation of the State of
Montana, with offices at 411 East Main, Bozeman, Montana 59715, GRANTEE, its successors and
assigns, a perpetual street and utility easement for the use of the public, in, through, and across a strip of
land situated in Gallatin County, Montana, sixty (60) feet wide to be for Cascade Street and Fallon Street
located across the following described real property:
Four tracts of land being the SE % of the NW %, the SW % of the NE %, the NE 1/4 of the SW %, the NW
% of the SE 1/4, all in Section 9, Township 2 South, Range 5 East, PMM, Gallatin County, Montana.
The easements are more particularly described on the attached Figures 1 and 2 which by this
reference is made a part hereof.
The GRANTOR states that he possesses the real property described above and that he has a
lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and
privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding upon the
heirs, executors, administrators, personal representatives, successors, and assigns of the parties hereto.

FOR CASCADE AND FALLON STREETS
LEGAL DESCRIPTION - CASCADE STREET
Being a public street and utility easement located in the
SE1/4NW1/4, SW1/4NE1/4, in Section 9, Township 2S, Range SE,
P.M.M. Gallatin County, Montana
A public street and utility easement being a 60.00 foot wide strip
of land lying 30.00 feet on each side of the following described
centerline;
Commencing at the East Quarter of Section 9. Thence
NS8"01'10"W for a distance of 2316.89 feet, to the True Point of
Beginning;
Thence N89'12'30"W for a distance of 623.63 feet;
Thence S89"S6'33"W for a distance of 1142.S7 feet;
Thence along an arc 46.00 feet to the right having a radius of
200.00 feet. a delta of 13" 1 0' 4S", a chord bearing of S 83"28'04"
E and a chord length of 4S.90 feet;
Thence S76'S2'41"E for a distance of 61.88 feet;
Thence along an arc 46.00 feet to the left having a radius of

A public street and utility easement being a 60.00 foot wide strip of
land lying 30.00 feet on each side of the following described
centerline;
Commencing at the East Quarter of Section 9. Thence
S46"36'22"W for a distance of 1882.64 feet, to the True Point of
Beginning;
Thence N89"34'10"W for a distance of 1327.27 feet;
Thence N89"34'06"W for a distance of 1334.24 feet. to the West line
of the NE1/4SW1/4 and the end of the centerline;
Said easement contains 3.67 acres, more or less;
