RELEASE AND RECONVEY ANCE OF EASEMENT
COME NOW the City of Bozeman, 411 E. Main, Bozeman, MT 59715, a Municipal
Corporation ofthe State of Montana hereinafter refered to as ("GRANTOR") and does hereby release
and reconvey the following described easement unto Lot 2D, Minor Subdivision No. 365-A and Lot
1 Minor Subdivision No. 295 located in the SW 1/4 of Section 10, T.2 S., R.5 E. ofP.M.M., City of
Bozeman, Gallatin County, Montana as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of la' Wide Utility easement(s) situated
across Lot 2D Minor Subdivision No. 365-A and Lot 1 Minor Subdivision No. 295 located in the SW
1/4 of Section 10, T.2 S., R.5 E. ofP.M.M., City of Bozeman, Gallatin County, Montana.
WHEREAS the above 10' Wide Utility easement was granted with the final plat of Minor
Subdivision No. 295 tiled on August 20,2001 at the Clerk and Recorder's Office of Gallatin County,
Montana.
WHEREAS the Final Plat for The Ridge Athletic Club Major Subdivsion has been approved
by the City of Bozeman for which construction will be completed without having to occupy said
easement, and WHEREAS the potential re-alignment of the 10' Wide Utility easements can be
appropriately considered with future subdivision review of these properties, the vacation of the said 10'
Wide Utility easement recorded on August 20,2001 will not adversely impact the Grantor's interests.
WHEREFORE, the Grantor does hereby release and reconvey to Ridge, LLC and Gallatin
Valley Health/Fitness Group, those portions of the easement located on the above described real
property as set forth on Exhibit A attached hereto together with any right, title, or interest that the
Grantor may have in said easements as set forth on Exhibit A attached hereto and incorporated herein

Dear Duane,
Enclosed is a copy of the approved site plan for the Ridge Athletic Club Site Plan and a copy of Exhibit
A, "Abandonment of Existing 10' Wide Utility Easement." The existing utility easement highlighted on
Exhibit A runs along the former property line between Lot 1 of Minor S ubdivi son No. 295 and Lot 2D of
Minor Subdivison No. 365-A. The property line will be removed and the utility easement will not work
with the site plan. We need your written consent to abandon the easement. Please look over the attached
site plan to ensure that the existing easement is no longer necessary. If you find that the easement is not
necessary to provide utility service please sign the certifying statement below:
The 10' wide utility easement along the former property line between Lot 1 of Minor
Subdivison No. 295 and Lot 2D of Minor Subdivison No. 365-A is not necessary for
Qwest to provide service to the surrounding properties. Qwest consents to the
abandonment of the easement.
