RELEASE AND RECONVEYANCE OF EASEMENT
COME NOW the City of Bozeman, 411 E. Main, Bozeman, MT 59715, a Municipal
Corporation of the State of Montana hereinafter referred to as ("GRANTOR") and does hereby
release and reconvey the following described easement unto Lot 2D and Lot 2C, Minor
Subdivision No. 365-A located in the SW 1/4 of Section 10, T.2 S., R.5 E. ofP.M.M., City of
Bozeman, Gallatin County, Montana as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of Stormwater easement situated
across Lot 2C Minor Subdivision No. 365-A and Lot 2D Minor Subdivision No. 365-A, and
described in "Detail 1 " of said plat, located in the SW 1/4 of Section 10, T.2 S., R.5 E. of
P.M.M., City of Bozeman, Gallatin County, Montana.
WHEREAS the above stormwater easement was granted with the final plat of Minor
Subdivision No. 365-A filed on August 4, 2006 at the Clerk and Recorder's Office of Gallatin
County, Montana.
WHEREAS the Final Plat for Minor Subdivision 365-A has been approved by the City of
Bozeman for which construction will be completed without having to occupy said easement, and
WHEREAS the potential re-alignment of the stormwater easement can be appropriately
considered with future subdivision review of these properties, the vacation of the said stormwater
easement recorded on August 4,2006 will not adversely impact the Grantor's interests.
WHEREFORE, the Grantor does hereby release and reconvey to Ridge, LLC and Gallatin
Valley Health/Fitness Group, those portions of the easement located on the above described real

Grantor may have in said easements as set forth on Exhibit A attached hereto and incorporated
herein by reference.
