- RELEASE AND RECONVEYANCE OF EASEMENT(S)
COMES NOW the City of Bozeman, 411 E. Main, Bozeman, MT 59715, a Municipal
Corporation of the State of Montana hereinafter ("GRANTOR") and does hereby release and reconvey the
following described easement(s) unto Bozeman Elementary District No.7 as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a waterline and storm drainage easement
situated across: Tract Al of the Amended Plat of Baxter Meadows Subdivision P.U.D. Phase 1, as filed
in Book J on Page 353D of Gallatin County records, all being located in the Southwest Quarter of Section
34, Township 1 South, Range 5 East, P.M.M., City of Bozeman, Gallatin County, Montana.
WHEREAS the above waterline and storm drainage easement was granted and recorded on
November 21, 2005 at the Clerk and Recorder's Office of Gallatin County, Montana.
WHEREAS the constructed location of the waterline and storm drainage facilities does not
conform with the planned construction of a new school building and other associated improvements, and
WHEREAS a new easement for waterline and storm drainage that conforms with said improvements, has
been executed on M"j IS , 2l:X)(;;;ld WHEREAS the potential re-alignment of the
waterline and storm drainage facilities can be appropriately considered with future subdivision review of
these properties, the vacation of all of the waterline and storm drainage easement recorded on November
21, 2005 will not adversely impact the Grantor's interests.
WHEREFORE, the Grantor does hereby release and reconvey to Bozeman Elementary
District No.7, all of the easement located on the above described real property as set forth on
Exhibit A attached bercto together with any right, title, or interest that the Grantor may have in
said easement as set forth on Exhibit A attachcd hcreto and incorporated herein by reference as
though fully set forth and described as follows: the Waterline and Stonn Drainage Easement and
Agreement described on Exhibit A of Document 2210035 of the records ofthc Gallatin County
Clerk and Recorder's Office.
