RELEASE AND RECONVEYANCE OF EASEMENT(S)
COME NOW the City of Bozeman, 411 E. Main, Bozeman, MT 59715, a Municipal
Corporation of the State of Montana hereinafter refered to as ("GRANTOR") and does hereby release
and reconvey the following described easement(s) unto Lot 1, Minor Subdivision No. 295, and Lots
2B and 2C Minor Subdivision No. 365-A located in the SW 1/4 of Section 10, T.2 S., R.5 E. of
P.M.M., City of Bozeman, Gallatin County, Montana as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of 30' Wide Linear Park/Trail
easement(s) situated across Lot 1, Minor Subdivision No. 295, and Lots 2B and 2C Minor Subdivision
No. 365-A, located in the SW 1/4 of Section 10, T.2 S., R.5 E. ofP.M.M., City of Bozeman, Gallatin
County, Montana.
WHEREAS the above 30' Wide Linear Park/Trail easement(s) were granted
with the final plat of Minor Subdivision No. 295 recorded on August 20,2001 at the Clerk and
Recorder's Office of Gallatin County, Montana.
WHEREAS a Site Plan has been approved by the City of Bozeman for which construction will
be completed without having to occupy said easements recorded on August 20, 2001, and WHEREAS
the potential re-alignment of the 30' Wide Linear Park/Trail easements can be appropriately considered
with future subdivision review of these properties, the vacation of all of said 30' Wide Linear Park/Trail
easement(s) recorded on August 20, 2001 will not adversely impact the Grantor's interests.
WHEREFORE, the Grantor does hereby release and reconvey to Cottonwood
Condominiums, Inc. and Gallatin Valley Health/Fitness Group, L.L.C., those portions of the
easement(s) located on the above described real property as set forth on Exhibit A attached hereto

together with any right, title, or interest that the Grantor may have in said easements as set forth on
Exhibit A
attached hereto and incorporated herein by reference.
This reconveyance shall not affect the remainder of that easement recorded with Minor
Subdivision No. 295, on August 20,2001 of record in the Clerk and Recorder's office of Gallatin
County, Montana.
