PUBLIC STREET AND UTILITY EASEMENT

Cascade Development. Inc. 1627 W Main S1. Suite #223. Bozeman. MT 59715, GRANTOR, in
consideration of $ 1.00 and for other and valuable considerations, receipt of which is
acknowledged, grants to The City of Bozeman, a municipal corporation of the State of Montana,
with offices at 411 East Main, Bozeman, Montana 59715, GRANTEE, its successors and
assigns, a public street and utility easement for the use of the public, in, through, and across a
strip ofland situated in Gallatin County, Montana, twenty-six (26.00) feet wide to be located on
the following described real property: Lots 1 & 2. Block 2. in the West Winds Maior
Subdivision Phase 3.
The easement is more particularly described on the attached Exhibit A which by this reference is
made a part hereof, and as described below:
An easement being a 26.00 foot wide strip lying along the alignment described
below:
Commencing at the Southwest Comer of West Winds Major Subdivision Phase 3
Township 2 South, Range 5 East, P.M.M., NOool7'08"W a distance of65.00 feet,
thence NOool7'08"W a distance of 451.51 feet to the True Point of Beginning
(P.O.B.);
Thence N90000'00''E a distance of27.33 feet, thence N45000'00"E a distance of
145.97 feet, thence N05013'48"W a distance of22.30 feet to the end of said
easement, containing 0.117 acres, more or less.
The GRANTOR states that he possesses the real property described above and that he has
.----/ a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors, and assigns of the
parties hereto.
