PUBLIC STREET EASEMENT
Cascade Development. Inc. 1627 W Main St. Suite #223. Bozeman. MT 59715, GRANTOR, in
consideration of$ 1.00 and for other and valuable considerations, receipt of which is
acknowledged, grants to The City of Bozeman, a municipal corporation of the State of Montana,
with offices at 411 East Main, Bozeman, Montana 59715, GRANTEE, its successors and
assigns, a public street easement for the use of the public, in, through, and across a strip ofland
situated in Gallatin County, Montana, twenty-six (26.00), feet wide to be located on the
following described real property: Lots 1 & 2. Block 2. in the West Winds Maior Subdivision
Phase 3.
The easement is more particularly described on the attached Exhibit A which by this reference is
made a part hereof, and as described below:
An easement being a 26.00 foot wide strip ofland along the alignment described
below:
Commencing at the Southwest Comer of West Winds Major Subdivision Phase 3
Township 2 South, Range 5 East, P.M.M., NOoolT08"W a distance of65.00 feet,
thence N21 041 '12"E a distance of321.81 feet to the True Point of Beginning
(P.O.B.);
Thence SOooOO' OO"E a distance of 1 07.73 feet to a point of curvature concave
northeasterly, thence along said curve to the left having an arc length of 133.26
feet, radius of 68.15 feet, central angle of 112001 '52", and a chord bearing
S56000'56"E a distance of 113.03 feet to a point of curvature concave southerly,
thence along said curve to the right having an arc length of 21.11 feet, radius of
100.00 feet, central angle of 12005'42", and a chord bearing N74000'59"E a
distance of 21.07 feet to a point of curvature concave southerly, thence along said
curve to the right having an arc length of 68.17 feet, radius of 196.56 feet, central
angle of 19052'19", and a chord bearing N90000'00"E a distance of67.83 feet to
a point of curvature concave southerly, thence along said curve to the right having
an arc length of21.11 feet, radius of 100.00 feet, central angle of 12005'42", and
a chord bearing S74000'59"E a distance of21.07 feet to a point of curvature
concave northwesterly, thence along said curve to the left having an arc length of
133.26 feet, radius of68.15 feet, central angle of 112001 '52", and a chord bearing
N56000' 56" a distance of 113.03 feet, thence NOOoOO'OO"W a distance of 1 08.31
feet to end of said easement, containing 0.354 acres, more or less.
The GRANTOR states that he possesses the real property described above and that he has

a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors, and assigns of the
parties hereto.
