PUBLIC ACCESS EASEMENT

Cascade Development. Inc. 1627 W Main St. Suite #223. Bozeman. MT 59715, GRANTOR, in
consideration of $ 1.00 and for other and valuable considerations, receipt of which is
acknowledged, grants to The City of Bozeman, a municipal corporation of the State of Montana,
with offices at 411 East Main, Bozeman, Montana 59715, GRANTEE, its successors and
assigns, a public access easement for the use of the public, in, through, and across a strip of land
situated in Gallatin County, Montana, ten (10.00) feet wide to be located on the following
described real property: Lots 1 & 2. Block 2. in the West Winds Maior Subdivision Phase 3.
The easement is more particularly described on the attached Exhibit A which by this reference is
made a part hereof, and as described below:
An easement being a 10.00 foot wide strip lying along the alignment described
below:
Commencing at the Southwest Corner of West Winds Major Subdivision Phase 3
Township 2 South, Range 5 East, P .M.M., NOOo 17' 08"W a distance of 65.00 feet,
thence NOOO 17' 08"W a distance of 312.83 feet to the True Point of Beginning
(P.O.B.);
Thence N89058'51 "E a distance of 198.87 feet, thence NOooOO'OO"E a distance of
17.95 feet, thence N89058'51"E a distance of 139.00 feet, thence SOooOO'OO"W a
distance of 18.06 feet, thence N90000'00''E a distance of 193.44 feet to the end of
said easement, containing 0.130 acres, more or less.
The GRANTOR states that he possesses the real property described above and that he has
a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors, and assigns of the
parties hereto.
