PUBLIC STREET AND UTILITY EASEMENT
ROSA CONSTRUCTION, INC., of P.O. Box 11113, Bozeman, MT 59719, GRANTOR, in
consideration of $ 1.00 and for other and valuable considerations, receipt of which is
acknowledged, grants to The City of Bozeman, a municipal corporation of the State of Montana,
with offices at 411 East Main, Bozeman, Montana 59715, GRANTEE, its successors and
assigns, perpetual street and utility easements for W. Oak Street, Sherwood Way, and Annie
Street for the use of the public, in, through, and across a strip ofland situated in Gallatin County,
Montana, 60 feet wide to be located on the following described real property: Tract B.
Certificate of Survey No. 2389. according to the plat thereof. on file and of record in the office of
the Clerk and Recorder. Gallatin County. Montana. and located in the East Half of the Southeast
Ouarter of Section 4.Township 2 South. Range 5 East ofP.M.M..
The easements are more particularly shown and described on the attached Exhibit A, which by
this reference is made a part hereof.
The GRANTOR states that he possesses the real property described above and that he has a
lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and
privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding upon the
heirs, executors, administrators, personal representatives, successors, and assigns of the parties
hereto.

LEGAL DESCRIPTION OF PUBliC STREET & UTILl1Y EASEMENT
Three perpetual easements for public street and utility purposes over,
under and across Tract B, Certificate of Survey No. 2389, located in
the East Half of the Southeast Quarter of Section 4, Township 2
South, Range 5 East, of P.M.M., Gallatin County, Montana. Said
easements are described as follows:
WEST OAK STREET
Beginning at the Northwest Corner of said Tract B; thence easterly
089. 35' 55", assumed azimuth from North, 662.43 feet along the
North line of said Tract B; thence southerly 181' 03' 01" azimuth
60.02 feet; thence westerly 269' 35' 55" azimuth 662.40 feet;
thence northerly 001' 01' 12" azimuth 60.02 feet to the point of
beginning.
Area = 39,745 sq ft, 0.912 acre
SHERWOOD WAY
Commencing at the Northwest Corner of said Tract B; thence
southerly 181' 01' 12", assumed azimuth from North, 684.01 feet
along the West line of said Tract B to the point of beginning of the
easement to be described; thence easterly 089. 59' 55" azimuth
661.97 feet; thence southerly 181' 03' 01" azimuth 60.01 feet;

ANNIE STREET
