RELEASE AND RECONVEYANCE OF EASEMENT(S)
COMES NOW the City of Bozeman, 411 E. Main, Bozeman, MT 59715, a
Municipal Corporation of the State of Montana hereinafter ("GRANTOR") and does
hereby release and reconvey the following described easem~nt unto Bozeman Deaconess
Foundation, City of Bozeman, Gallatin County, Montana as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a sanitary sewer outfall
line easement situated on Tract 3. of Certificate of Survey 2047 COS 2047. as described
in the easement recorded on Film 135. pa~es 576 and 577. City of Bozeman, Gallatin
County, Montana.
WHEREAS the above sanitary sewer outfall line easement was granted October
27, 1960 and recorded on November 14, 1960 at the Clerk and Recorder's Office of
Gallatin County, Montana.
WHEREAS the construction of a municipal sanitary sewer mam has been
completed without having to occupy said easement recorded on November 14, 1960, and

WHEREAS the extension of municipal sanitary sewer mains can be appropriately
considered with future subdivision review of these properties and the vacation of the
sanitary sewer outfall line easement recorded on November 14, 1960 will not adversely
impact the Grantor's interests,
WHEREFORE, the Grantor does hereby release and reconvey to Bozeman
Deaconess Foundation the easement located on the above described real property as set
forth on Exhibit A attached hereto together with any right, title, or interest that the
Grantor may have in said easement as set forth in Exhibit A attached hereto and
incorporated herein by reference as though fully set forth and described as follows: an
easement for a sanitary sewer outfall line as described in Book 135 pages 576 and 577,
This reconveyance shall not affect other easements of record in the Clerk and
Recorder's OffiCe~Gallatin county,. Montana.
