RELEASE AND RECONVEYANCE OF EASEMENT
COMES NOW the City of Bozeman, 411 E. Main, Bozeman, MT 59715, a Municipal
Corporation of the State of Montana hereinafter ("GRANTOR") and does hereby release and
reconvey the following described easement unto Benson Meadows L.L.C. of 1620 Central
Avenue, Suite 202, Cheyenne, Wyoming 82002 hereinafter ("GRANTEE"), as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a Temporary Access Easement
and Agreement recorded as Document No. 2161165, Records ofthe Clerk and Recorder, Gallatin
County, Montana, situated across the Grantee's tract of land located in the Northwest Quarter of
Section 11, Township 2 South, Range 5 East, P,M.M, Gallatin County, Montana, known as 2813
West Babcock Street, and described as Tract B of Certificate of Survey 1805, Records ofthe
Clerk and Recorder, Gallatin County, Montana.
WHEREAS the above Temporary Access Easement and Agreement was granted on
August 25, 2004 and recorded on August 26, 2004 at the Clerk and Recorder's Office of Gallatin
County, Montana, and
WHEREAS the construction of the improvements to West Babcock Street have been
completed and the use of said easement recorded on August 26, 2004, was temporary to allow
access to the property during construction of the improvements, the vacation of said easement
will not adversely impact the Grantor's interests.
WHEREFORE, the Grantor does hereby release and reconvey to Benson Meadows
..
L.L.C. said easement recorded on August 26, 2004 together with any right, title, or interest that
the Grantor may have in said easement.
