RELEASE AND RECONVEYANCE OF EASEMENT
COMES NOW the City of Bozeman, 411 E. Main, Bozeman, MT 59715, a Municipal
Corporation of the State of Montana hereinafter ("GRANTOR") and does hereby release and
reconvey the following described easement unto Stephen H. Davenport and Nancy H.
Davenport, of P.O. Box 2055, Mechanicsburg, Pennsylvania 17055, hereinafter ("GRANTEE"),
as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a Temporary Access Easement
and Agreement recorded as Document No. 2171452, Records of the Clerk and Recorder, Gallatin
County, Montana, situated across the Grantee's tract of land located in the Southeast Quarter of
Section 11, Township 2 South, Range 5 East, P.M.M, Gallatin County, Montana and described
as Tract VW-l of Certificate of Survey 1227, Records of the Clerk and Recorder, Gallatin
County, Montana.
WHEREAS the above Temporary Access Easement and Agreement was granted on
November 5, 2004 and recorded on November 30, 2004 at the Clerk and Recorder's Office of
Gallatin County, Montana, and
WHEREAS the construction of the improvements to West Babcock Street have been
completed and the use of said easement recorded on November 30, 2004, was temporary to allow
access to the property during construction of the improvements, the vacation of said easement
will not adversely impact the Grantor's interests.

WHEREFORE, the Grantor does hereby release and reconvey to Stephen H. Davenport
and Nancy H. Davenport said easement recorded on November 30, 2004 together with any right,
title, or interest that the Grantor may have in said easement.

executed the same for and on behalf of the City of Bozeman.
