RELEASE AND RECONVEYANCE OF EASEMENT
COMES NOW the City of Bozeman, 411 E. Main, Bozeman, MT 59715, a Municipal
Corporation of the State of Montana hereinafter ("GRANTOR") and does hereby release and
reconvey the following described easement unto Net Lease Funding 2005, LP, a Delaware
limited partnership, hereinafter ("GRANTEE"), and American Pizza Partners, LP, a Delaware
limited partnership, hereinafter ("Tenant"), as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a Temporary Easement
recorded as Document No. 2193659, Records ofthe Clerk and Recorder, Gallatin County,
Montana, situated across the Grantee's tract of land located in the Southeast Quarter of Section
11, Township 2 South, Range 5 East, P.M,M, Gallatin County, Montana, known as 2300 West
Main Street, and described in Film 122, Page 2776, Records ofthe Clerk and Recorder, Gallatin
County, Montana.
WHEREAS the above Temporary Easement was granted on May 25, 2005 and recorded
on July 8, 2005 at the Clerk and Recorder's Office of Gallatin County, Montana, and
WHEREAS the construction of the improvements to West Babcock Street have been
completed and the use of said easement recorded on July 8, 2005, was temporary to allow access
to the property during construction of the improvements, the vacation of said easement will not
adversely impact the Grantor's interests.
WHEREFORE, the Grantor does hereby release and reconvey to Net Lease Funding
..
2005, LP, and American Pizza Partners, LP, said easement recorded on July 8, 2005 together
with any right, title, or interest that the Grantor may have in said easement.
