DETENTION POND DRAINAGE EASEMENT
City of Bozeman, PO Box 1230, Bozeman, MT 59771-1230 , GRANTOR, in consideration of
One Dollar ($1.00) and other good and valuable consideration, receipt of which is
acknowledged, grants to the West Winds Master Homeowners' Association, Inc. P.O. Box 1501.
Bozeman, MT 59771, GRANTEE, its successors and assigns, an easement for public drainage
detention pond purposes, in, through and across the following described real property situated in
Gallatin County, Montana, more particularly described as follows and on the attached Exhibit
"A":
A public storm drainage detention pond easement across west Winds Major
Subdivision Phase 2A, as filed with the Gallatin County Clerk and Recorder
located in the NW 14 of Section 2, Township 2 South, Range 5 East, P.M.M.,
Gallatin County, Montana.
Commencing at the Center 14 comer of said Section 2, N 38058'07"E, a distance
of 1,510.96 feet, to the True Point of Beginning (P.O.B.) of the easement;
Thence N 90000'00"W a distance of 60.00 feet, thence N OooOO'OO"E a distance
of25.00 feet, then N 19053'44"W a distance of 111.66 feet, thence N OooOO'OO"E
a distance of30.00 feet, thence N 90000'00"E a distance of98.00 feet, thence S
OooOO'OO"E a distance of 160.00 feet to the P.O.B. of said easement containing
0.29 acres, more or less.
The GRANTOR warrants that it is lawfully seized and possessed of the real property described
above, that it has lawful right to convey the property, or any part of it, and that it will forever
defend the title of the property against the claims of all persons. The GRANTOR further agrees
that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted
without any interruption by the GRANTOR.
The terms, covenants and provisions of the easement and agreement shall extend to and be
binding upon the heirs, executors, administrators, personal representatives, successors and
assigns of the parties hereto.
