PUBLIC STREET AND UTILITY EASEMENT
Heritage Christian School, with offices at 4310 Durston Road, Bozeman, Montana, 59718, GRANTOR, in
consideration of $ 1.00 and for other and valuable considerations, receipt of which is acknowledged, grants to The
City of Bozeman, a municipal corporation of the State of Montana, with offices at 411 East Main, Bozeman,
Montana 59715, GRANTEE, its successors and assigns, a perpetual street and utility easement for the use of the
public, in, through, and across a strip ofland situated in Gallatin County, Montana, 45 feet wide, to be located on the
following described real property:
Parcel B ofC.O.S. 1829
The easement is more particularly described on the attached Exhibit A which by this reference is made a
part hereof.
The GRANTOR states that it possesses the real property described above and that it has a lawful right to
grant an easement thereon.
The GRANTOR further agrees that the GRANTEE niay peaceably hold and enjoy the rights and privileges
herein granted without any interruption by the GRANTOR.
The temls, covenants, and provisions of this easement shall extend to and be binding upon the heirs,
executors, administrators, personal representatives, successors, and assigns of the parties hereto.

1829 located in the NW1/4 Section 10, T2S, R5E, P.M,M, City of
Bozeman, Gallatin County, Montana, and being further described as
follows:
A strip of land, the north line of which is the north line of said Parcel
B, the east and west lines of which are the east and west lines of said
Parcel B, and the south line of which lies 45.0 feet, when measured at
right angles, south of and parallel with the north line of said Parcel B,
said south line being extended or truncated as necessary to meet the
east and west lines of said Parcel B.
