PUBLIC ACCESS EASEMENT
Ridge Investment LLC PO Box 11077, Bozeman, MT 59719, GRANTOR(S), in consideration
of$ 1.00 and for other and valuable considerations, receipt of which is hereby acknowledged,
grants to The City of Bozeman, a Municipal Corporation of the State of Montana, with offices at
411 East Main, Bozeman, Montana 59715, GRANTEE, a public access easement for a driveway
and parking area for the use of the public in, through, and across a 35 feet wide strip ofland
situated in Gallatin County, Montana, which is located on the following described property:

Subdivision Phase 1a & 1b

Commencing at a point that is the Northeast comer of Block 3, Lot 4 of West Winds Major
Subdivision Phase 1A and the South Right-of-Way of Cobblestone Place at the intersection of
the West Right-of-Way of North 27th Avenue, Thence North 88012'21" West, 85.03 feet, along
the South Right-of-Way of Cobblestone Place to the Point of Beginning (P.O.B.).
Thence, South 01047'39" West, 235.59 feet;
Thence, South 89057'41" East, 73.05 feet, to a point on the West side of an existing utility
easement;
Thence, South 01047'38" West, 35.02 feet, along existing utility easement;

South Right-of-Way of Breeze Lane to the Point of Beginning (P.O.B.).

Right-of-Way of Breeze Lane to the Point of Beginning (P.O.B.).

Thence, North 90000'00" East, 73.11 feet, to a point on the West side of an existing utility
easement;
Thence, North 01047'54" East, 35.02 feet, along existing utility easement;
Thence, North 90000'00" West, 188.17 feet, to a point on the East Right-of-Way of Tempest
Court;
Thence, South 01047'39" West, 35.02 feet, along the East Right-of-Way of Tempest Court;

Thence, South 01047'39" West, 246.11 feet, to a point on the North Right-of-Way of Breeze
Lane;
Thence, South 88012'21" East, 35.00 feet, along the North Right-of-Way of Breeze Lane to the
Point of Beginning, containing 0.349 acres.
The easement is more particularly described on the attached Exhibit A which by this reference is
made a part hereof.
The GRANTOR(S) agrees:
(1) To construct and maintain the driveway and parking area at their own expense in
accordance with relevant City Ordinances, including, but not limited to, snow removal
and all major and minor repair work.
(2) To allow the City to make any and all inspections ofthe driveway and parking area and
land appurtenant thereto as the City reasonably deems necessary.
The GRANTOR(S) warrant that they are lawfully seized and possessed of the real
property described above, that they have a lawful right to convey the property, or any part of
it, and that they will forever defend the title to this property against the claims of all persons.
The GRANTOR(S) further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTORS. The terms,
covenants and provisions of this easement shall extend to and be binding upon the heirs,
executors, administrators, personal representatives, successors and assigns ofthe parties hereto.
