IN CONSIDERATION of the swn of Seventeen thousand seven hundred ninety five and
50/100 Dollars ($17,795.50), receipt whereof is hereby acknowledged, Stephen P. McGough,
Grantor, residing at 2813 West Babcock Street, Bozeman, Montana 59718 does hereby grant,
bargain, sell, convey, warrant and confirm unto the City of Bozeman, a political subdivision of
the State of Montana, P.O. Box 1230, Bozeman, Montana 59771-1230, the Grantee, all of his
right, title and interest including all future interests, if any, in and to the real property situated in
the County of Gallatin, State of Montana and which is described as follows:
A tract of land located in the Northwest Quarter of Section 11, Township 2 South,
Range 5 East, P.M.M., Gallatin County, Montana, being more particularly
described as follows:
A strip of land being 32.50 feet wide, lying on the south side of a line that
is lengthened or shortened, as required, to terminate on the east and west
lines of Tract B, Certificate of Survey 1805, as filed with the Gallatin
County Clerk and Recorder, said line being parallel to and 32.50 feet
distant, northerly, when measured at right angles from the following
described line:
Beginning at a point on the south line of the said Northwest Quarter, being
the southerly projection of the said east line of Tract B, said point bearing
North 89011'19" West a distance 3,230.94 feet, more or less, from the east
quarter comer of said Section 11; thence continuing along the south line of
the Northwest Quarter, North 89011'19'1 West a distance of 144.00 feet,
more or less, to the southerly projection of the said west line of Tract B,
and the end of the line herein described.
Said strip ofIand containing 4,609 square feet more or less.

EXCEPTING AND RESERVING, however, all gas and oil beneath the surface of the above-
described and conveyed premises, together with the right to extract the same, provided that in the
exercise of such right the surface thereof shall not be disturbed, interfered with, or in any way
damaged.
TO HAVE AND TO HOLD the above described and conveyed premises, with all the reversions,
remainders, tenements, hereditaments and appurtenances thereto unto the CITY OF BOZEMAN,
and to its successors and assigns forever.
THE GRANTOR and his successors and assigns does hereby covenant that he will forever
warrant and defend all right, title, and interest in and to the premises and the quiet and peaceable
possession thereof unto the CITY, its successors and assigns against the acts and deeds of the
GRANTOR and all and every person and persons whomsoever lawfully claiming or to claim the
same.
THE PARTIES hereto acknowledge that this deed is executed under the threat of
condemnation and, therefore under ~76-3-201(1)(a), is exempt from all subdivision
requiremen ts.
