TEMPORARY DRAINAGE EASEMENT
Blackleaf Group. LLC.. with offices at 321 East Main Street. Suite 208. Bozeman. MT 59715,
GRANTOR, in consideration of One Dollar ($1.00) and other good and valuable consideration, receipt of
which is acknowledged, grants to the City of Bozeman, a municipal corporation of the State of Montana,
with offices at 411 East Main, Bozeman Montana 59715, GRANTEE, its successors and assigns, a
temporary easement for public drainage purposes, in, through and across the following described real
property situated in Gallatin County, Montana, and on the attached Exhibit "A":
Legal Description
A 15 foot wide strip ofland located in Tract 1 of Certificate of Survey No. 985. in the NW Y4 of Section
10. Township 2 South. Range 5 East. P.M.M.. City of Bozeman. Gallatin County. Montana. more
particularly described as follows:
The South 15 feet of the North 65 feet of Certificate of Survey No. 985. in the Northwest Y4 of Section 10,
Township 2 South. Range 5 East. P.M.M.. City of Bozeman. Gallatin County. Montana.
Said strip contains 0.207 acres. more or less. and is subiect to any easements either of record or apparent
on the ground.
Said easement shall last until the certificate of final occupancy for the final phase of development has
been granted by the City of Bozeman.
The GRANTOR warrants that it is lawfully seized and possessed of the real property described above,
that it has lawful right to convey the property, or any part of it, and that it will forever defend the title of
the property against the claims of all persons. The GRANTOR further agrees that the GRANTEE may
peaceably hold and enjoy the rights and privileges herein granted without any interruption by the
GRANTOR.
The terms, covenants and provisions of the easement and agreement shall extend to and be binding upon
the heirs, executors, administrators, personal representatives, successors and assigns of the parties hereto.
