RESOLUTION NO. 3993
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE GROWTH POLICY LAND USE DESIGNATION,
AS SHOWN ON THE FUTURE LAND USE MAP IN THE BOZEMAN 2020
COMMUNITY PLAN, FROM FUTURE URBAN TO RESIDENTIAL FOR 221
ACRES AND TO BUSINESS PARK FOR 20 ACRES, AS ALLOWED BY
SECTION 76-1-604(3)(A), MONTANA CODE ANNOTATED (MCA) AND
SECTION 2.4, BOZEMAN 2020 COMMUNITY PLAN.
WHEREAS, the proposed growth policy amendment to amend the growth policy
land use designation, as shown on the Future Land Use Map in the Bozeman 2020
Community Plan, from Future Urban to Residential for 221 acres and to Business Park
for 20 acres has been properly submitted, reviewed and advertised; and
WHEREAS, the Bozeman Planning Board held a public hearing on February 7,
2006, to receive and review all written and oral testimony on the request for a growth
policy amendment; and
WHEREAS, the Bozeman Planning Board voted 0 in favor and 8 against to
forward to the Bozeman City Commission an recommendation of denial for said growth
policy amendment; and
WHEREAS, after proper notice, the City Commission held its public hearing on
February 27, 2006, to receive and review all written and oral testimony on the request for
a growth policy amendment; and
WHEREAS, the City Commission has reviewed and considered the four growth
policy amendment criteria established in Section 2.4.1 of the Bozeman 2020 Community
Plan, and found that the growth policy amendment would be in compliance with the four
criteria; and

NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City
of Bozeman, Montana:
Section 1
That upon a vote of 3-1, the growth policy land use designation for the following-
described properties is hereby designated as Residential:
Property located in the NW 1/4 of Section 9, Township 2 South, Range 5 East, P.M.M.,
Gallatin County, Montana, being more particularly described as follows:
Commencing at the NW 1/16 Comer of Section 9, being the Point of Beginning.
Thence North 89056'33" East a distance of 669.32 feet;
Thence South 02026'38" West a distance of 1346.58 feet;
Thence North 89039'23" West a distance of 669.44 feet;
Thence North 02027'31" East a distance of 1341.92 feet, to the True Point of Beginning.

Commencing at the South Quarter Comer of Section 9.
Thence South 55023'27" West a distance of 54.34 feet to the South right-of-way of U.S.
Highway 191, as described on C.O.S. 1456, to the Point of Beginning.
Thence North 01030'31" West a distance of 740.24 feet;
Thence South 89034'13" East a distance of 1464.61 feet;
Thence South 02008'35" West a distance of 743.32 feet to the South right-of-way of U.S.
Highway 191, a described on C.O.S. 1456;
Thence along said Right of way, North 89026' West a distance of 1417 feet more or less,
as described on C.O.S. 1456 to the True Point of Beginning;

Section 2
This growth policy amendment shall be in full force and effect upon passage.
