FAX: (406) 582-2263 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Brian Heaston, Project Engineer Chris Kukulski, City Manager SUBJECT: Public Street & Utility Easement - Zach Anderson MEETING DATE: February 5, 2007 Consent Agenda BACKGROUND: A partially executed public street and utility easement between Zach Anderson and the City of Bozeman is attached. The easement encompasses the northern 15' of Lot 13 in Block 2 of a Plat of Richards Subdivision, which is situated on the south side of West Babcock Street between S. 19th Ave. and S. 15th Ave. The easement will provide land to accommodate future expansion of West Babcock Street to a collector standard per the current Transportation Plan. Engineering staff has reviewed the document and has found it to be acceptable. RECOMMENDATION: Staff recommends the City Commission make a motion authorizing the City Manager to sign the easement. Mendenhall, Suite C-l Bozeman, MT 59715 PUBLIC STREET EASEMENT Zack Anderson, GRANTOR, in consideration of $ 1.00 and for other and valuable considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal corporation of the State of Montana, with offices at 411 East Main, Bozeman, Montana 59715, GRANTEE, its successors and assigns, a perpetual street and utility easement for the use of the public, in, through, and across a strip of land situated in Gallatin County, Montana, 15 feet wide to be located on the following described real property: Lot 13 in Block 2 of A Plat of the Richards Subdivision to the City of Bozeman, located in the SW ~ of Section 12, T2S, R5E, P.M.M., Gallatin County, Montana. The north line of the 15.00' wide easement is more particularly described as follows: Beginning at the northwest comer of said Lot 13; thence North 89008'40" East, along the north line of Lot 13, a distance of70.00' to the northeast corner of said lot, there terminating. The south line of said easement to be extended or shortened to terminate on the east and west lines of Lot 13. The GRANTOR states that he possesses the real property described above and that he has a lawful right to grant an easement thereon. The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTOR. The terms, covenants, and provisions of this easement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors, and assigns of the parties hereto.
