HomeMy WebLinkAboutOrdinance 07- 1686 Amend BMC Revising Sec. 2.66.030 Providing Terms for Members of City Planning Board ORDINANCE NO. 1686 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, PROVIDING THAT THE BOZEMAN MUNICIPAL CODE BE AMENDED BY REVISING SECTION 2.66.030; PROVIDING FOR CERTAIN TERMS FOR MEMBERS OF THE CITY PLANNING BOARD. WHEREAS, on the 7th day of June 1999, the City Commission adopted Ordinance No. 1494, creating the City Planning Board; and WHEREAS, on the 3rd day of January 2002, the Commission adopted Ordinance No. 1508, expanding the membership of the board; and WHEREAS, the terms of all members expire on the same date; and WHEREAS, the Commission has determined it would be preferable to have staggered terms on the board. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That Section 2.66.030 of the Bozeman Municipal Code be amended so that such section shall read as follows: "2.66.030 Composition. The Bozeman Planning Board shall consist of nine members, appointed to two year terms to expire on January 31, as follows: A. One member appointed by the City Commission from its own membership. The term of the appointed member shall be coextensive with the term of office to which he or she has been elected or appointed unless the Commission, on its first regular meeting of each year, appoints another to serve as its representative or unless the appointee's Commission term is terminated; B. Three members appointed by the City Commission one of whom, at the Commission's discretion, may be an employee of the City of Bozeman or hold public office in Bozeman or Gallatin County. Initial terms of these members shall be for one year, thereafter the The appointments shall be for two-year terms. with those terms to expire on January 31 of odd- numbered years; C. One member appointed by the Mayor, upon designation by the Gallatin County Board of Commissioners, who may be a member of the Board of County Commissioners or an office holder or employee of the County. This appointment shall be coterminous ','lith the term of the Mayor shall expire on January 31 of odd-numbered years; D. Four citizen members appointed by the Mayor, who shall be resident freeholders within the city limits, and who shall be qualified by knowledge and experience in matters pertaining to the development of the city. These appointments shall be coterminous with the term of the Mayor. The Clerk of the City Commission City Clerk shall certify the members appointed by the City Commission. The certificates shall be sent to and become a part of the records of the Bozeman Planning Board. The Mayor shall make similar certification for the appointment of citizen members." Section 2 Repealer. All resolutions, ordinances and sections of the Bozeman Municipal Code and parts thereof in conflict with the application of this ordinance are hereby repealed. Section 3 Severability. If any provisions of this ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect the other provisions of this ordinance which may be given effect without the invalid provision or application and, to this end, the provisions of this ordinance are declared to be severable. Section 4 Savings Provision. This ordinance does not affect the rights or duties that matured, penalties and assessments that were incurred or proceedings that begun before the effective date of this ordinance. Section 5 Effective Date. This ordinance shall be in full force and effect thirty days from final passage. PROVISIONALL Y PASSED by the City Commission of the City of Bozeman, Montana, on the first reading at a regular session thereof held on the 18th day December, 2006. FINALLY PASSED, ADOPTED, AND APPROVED by the City Commission of the City of Bozeman, Montana, on second reading at a regular session thereof held on the 8th day of January, 2007.
