COMMISSION RESOLUTION NO. 2798 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING SPECIAL IMPROVEMENT DIS- TRICT NO. 655 FOR THE PURPOSE OF ACCOMPLISHING THE EN- GINEERING DESIGN, CONSTRUCTION, INSTALLATION, IN- SPECTION AND ENGINEERING CERTIFICATION OF ASPHALT STREET PAVING, INTEGRAL CURB AND GUTTER AND STORM DRAINAGE IMPROVEMENTS ON CONCORD DRIVE AND A PORTION OF AN UNNAMED NORTH/SOUTH STREET IN WESTFIELD SUBDIVISION, PHASE" (FORMERLY REFERRED TO AS FIELDSTONE DRIVE), AND ALL OTHER NECESSARY APPURTENANCES TO LOCAL STANDARDS LESS SIDEWALKS; AND SIDEWALK IMPROVEMENTS ALONG THE WEST SIDE OF THAT PORTION OF WAGON WHEEL ROAD BORDERING WESTFIELD SUBDIVISION, PHASE II. WHEREAS, at a regular session of the City Commission of the City of Bozeman, Montana, held on the 4th day of June 1990, the said City Commission duly passed Commission Resolution No. 2786, declaring it to be the intention of said City Commission to create a Special Improvement District to be known and designated as Special Improvement District No, 655 for the purpose of accomplishing the engineering design, construction, installation, inspection and engineering certification of asphalt street paving, integral curb and gutter and storm drainage improvements on Concord Drive and a portion of an unnamed north/south street in Westfield Subdivision, Phase II (formerly referred to as Fieldstone Drive), and all other necessary appurtenances to local standards less sidewalks; and side improvements along the west side of that portion of Wagon Wheel Road bordering Westfield Subdivision, Phase II. That said Commission Resolution No. 2786 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special I mprovement District No. 655, the estimated cost of said improvements and the method of assessing the same against the property of the district; and WHEREAS, the notice of the passage of Commission Resolution No. 2786 was duly published, as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and published in the City of Bozeman, Montana, and by sending a copy of such notice by U.S. Mail to each person, firm or corporation having property within the proposed district at his or its last known address, upon the same date that such notice as first published as aforesaid, and due proof having been made of the publication and service of said notice; and WHEREAS, within the time provided by law and said published and served notice, there was not sufficient protest against the creation of said proposed Special Improvement District No. 655. The City Commission was in regular session on the 4th day of June 1990, at 7;00 o'clock p.m" at the Com- ~..- .. .. - 2 - mission Chamber in the City Hall Bui Iding in the said City of Bozeman, Montana. The same was the time and place designated in said notice for pass- ing upon all protests, if any, against the proposed work or against the creation of said district. And, it further appears that all of the proceedings for the creation of said district have been lawful and regular. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA: Section 1 That the said Special Improvement District No. 655 of the City of Bozeman be and the same is hereby created for the purpose of making improve- ments as set out in said Commission Resolution No. 2786 and hereinafter de- scribed. Section 2 That said special improvements be and the same are hereby ordered to be made in Special Improvement District No. 655 as follows: THE ENGINEERING DESIGN, CONSTRUCTION, INSTALLATION, INSPECTION AND ENGINEERING CERTIFICATION OF ASPHALT STREET PAVING, INTEGRAL CURB AND GUTTER AND STORM DRAINAGE IMPROVEMENTS ON CONCORD DRIVE AND A PORTION OF AN UNNAMED NORTH/SOUTH STREET IN WESTFIELD SUBDIVISION, PHASE" (FORMERLY REFERRED TO AS FIELDSTONE DRIVE), AND ALL OTHER NECESSARY APPURTENANCES TO LOCAL STANDARDS LESS SIDEWALKS; AND SIDEWALK IMPROVEMENTS ALONG THE WEST SIDE OF THAT PORTION OF WAGON WHEEL ROAD BORDERING WESTFIELD SUBDIVISION, PHASE I I. Section 3 That the entire cost and expense of the improvements herein referred to in said Special Improvement District No. 655 shall be assessed against the entire district. Each lot, block, tract or parcel of land within the district boundary will be assessed for that portion of the whole cost which its area bears to the area of the entire district, exclusive of streets, alleys and public places. The total actual assessable area within the entire district is 327,776 square feet and is the area on which all assessments wi II be calculated. It is also the square footage on which all assessments will be figured.
