A RESOLUTION OF THE CITY
COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, CREATING A
CITY-WIDE MAINTENANCE
DISTRICT FOR ALL STREETS,
ALLEYS AND PUBLI C P LA C ES
LOCATED WITHIN THE
CITY'S CORPORATE LIMITS, AND
REPEALING COMMISSION RESOLUTION
NOS. 1650, CREATING
SPRINKLING DISTRICT NO. 5;

WHEREAS, at a regular session of the City Commission of the City of
Bozeman, Montana, held on the 4th day of June 1990, the said City Commission
duly passed Commission Resolution No. 2795, declaring it to be the intention of
said City Commission to create a city-wide maintenance district for all streets,
alleys and public places located within the City's corporate limits and repeal,
effective June 30, 1990, Commission Resolution Nos. 1650, 1651, 1652, 1653 and
1654 which formerly established Sprinkling District Nos. 5,
6, 7, 8 and 9 for
the purpose of providing street maintenance in
specified areas of the com-
munity. That said Commission Resolution No. 2795 is hereby referred to and is
hereby incorporated by this reference as
through fully set forth herein for
further particulars in respect to the boundaries of said street maintenance dis-
trict, the estimated annual cost of said maintenance and the method of assessing
the same against the property of the district; and
WHEREAS, the notice of the passage of Commission Resolution No.
2795
was duly publ ished , as required by law,
in the Bozeman Daily Chronicle,
a
daily newspaper of general circulation printed
and published in the
City of
Bozeman, Montana, and due proof having been made of the publication; and
WHEREAS, within the time provided by law and after said published and
served notice, there was not sufficient
protest against the creation of sa
id
proposed street maintenance district. The City Commission was in regular ses-
sion on the 9th day of July 1990, at 7:00 o'clock p.m., at the Community Room
of the Gallatin County Courthouse in the said City of Bozeman, Montana. The
same was the time and place designated in said notice for passing upon all pro-
tests, if any, against the proposed work or against the creation of said dis-
trict. And, it further appears that all of the proceedings for the creation of
said district have been lawful and regular.
NOW, THEREFORE, BE IT
RESOLVED BY THE CITY COMMISSION
OF
THE CITY OF BOZEMAN, MONTANA:

Section
1
ThiJt the said city-wide street maintenance
district for the City of
Bozeman be and the same is hereby created for the purpose of maintenance as
set out in said Commission Resolution No. 2795 and hereinafter described.
Section
2
That said maintenance be and the same is hereby ordered to be made in
the city-wide street maintenance district, as follows:
MAINTENANCE FOR ALL STREETS, ALLEYS AND PUBLIC PLACES
LOCATED WITHIN THE CITY'S CORPORATE LIMITS.
Section
3
That the entire cost and expense of the maintenance to be done in said
street maintenance district shall be assessed against the entire district. Each
lot, bloc k , tract or parcel of land within the district boundary will be assessed
for that portion of the whole cost which its area bears to the area of the entire
district, exclusive of streets, avenues and alleys, as set forth
in Commission
Resolution No. 2795.
The total actual assessable area within the entire district is 142,934,000
square feet and is the area on which all assessments will be calculated. It is
also the square footage on which all assessments will be figured.
