COMMISSION RESOLUTION NO. 2804
A RESOLUTION OF THE CITY
COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, CREATING A
CITY-WIDE TREE MAIN-
TENANCE DISTRICT FOR THE
PURPOSE OF PLANTING AND
MAINTAINING TREES IN ALL PUBLIC PLACES, RIGHTS-OF-WAY
AND PARKS.
WHEREAS, at a regular session of the City Commission of the City of
Bozeman, Montana, held on the 4th day of June 1990, the said City Commission
duly passed Commission Resolution No. 2796, declaring it to be the intention of
said City Commission to create a city-wide
tree maintenance district for
the
purpose of planting and maintaining trees in
all public places,
rights-of-way
and parks. That said Commission Resolution
No. 2796 is hereby referred
to
and by this reference incorporated as though fully set forth herein for further
particulars in respect to the boundaries of said tree maintenance district, the
estimated annual cost of said maintenance and the method of assessing the same
against the property of the district; and
WHEREAS, the notice of the passage of Commission Resolution No.
2796
was duly pub I ished, as required
by law, in the Bozeman Daily
Chronicle, a
daily newspaper of genera I circulation printed
and published in the City
of
Bozeman, Montana and due proof having been made of the publication; and
WHEREAS, within the time provided by law and after said published and
served notice, there was not sufficient
protest against the creation
of said
proposed tree maintenance district. The City Commission was in regular session
on the 9th day of July 1990, at 7:00 o'clock p.m., at the Community Room of
the Gallatin County Courthouse in the
said City of Bozeman, Montana. The
same was the time and place designated
in said notice for passing
upon all
p rotes ts , if any, against the proposed
work or against the creation of sa id
district. And, it further appears that all of the proceedings for the creation of
said district have been lawful and regular.
NOW, THEREFORE, BE IT RESOLVED
BY THE CITY COMMISSION
OF
THE CITY OF BOZEMAN, MONTANA:
Section 1
That the city-wide tree maintenance district of the City of Bozeman be
and the same is hereby created for the purpose of maintenance as set out in
said Commission Resolution No. 2796 and hereinafter described.

Section 2
That said maintenance be and the same is hereby ordered to be made in
the tree maintenance district, as follows:

AND PARKS.
Section 3

That the entire cost and expense of the improvements herein referred to

in the city-wide tree maintenance district shall be assessed against the entire
district. Each lot, block, tract or parcel of land within the district boundary
will be assessed for that portion of the whole cost which its area bears to the
area of the entire district, exclusive of streets, avenues and alleys.
The total actual assessable area within the entire district is 142,934,000
square feet and is the area on which all assessments will be calculated. It is
also the square footage on which all assessments will be figured.
PASSED AND ADOPTED by the City Commission of the City of Bozeman,
Montana, at a regular session thereof held on the 16th day of July 1990.
