COMMISSION RESOLUTION NO. 2813
A RESOLUTION OF THE COMMISSION
OF THE CITY OF
BOZEMAN, MONTANA, LEVYING AND ASSESSI
NG SPRI NKLI NG
DISTRICT MAINTENANCE COST FOR
SPECIAL IMPROVEMENT
SPRINKLING DISTRICTS OF THE CITY OF BOZEMAN, PURSUANT
TO THE PROVISIONS OF SECTIONS
7-12-4401 THROUGH
7-12-4429, M.C.A.
WHEREAS, on the 16th day of July 1990, the City Commission
adopted
Commission Resolution No. 2803, creating a city-wide street maintenance dis-
trict; and
WHEREAS, Commission Resolution No.
2803 repealed and abol ished
Sprinkling District Nos. 5, 6, 7, 8 and 9 through the creation
of said street
maintenance district; and
WHEREAS, the final assessment for said Sprinkling District Nos. 5, 6, 7,
8 and 9 has not been assessed.
NOW, THEREFORE, BE IT RESOLVED
BY THE CITY COMMISSION OF
THE CITY OF BOZEMAN:
Section 1
That pursuant to the direction and authority of the provisions of Section
7-12-4425, MCA, and based upon costs of sprinkling in the several Special Im-
provement Sprinkling Districts of the City of Bozeman hereinafter specified, for
the Fiscal Year ended June 30, 1990,
there is hereby levied and assessed
against the property and several lots, pieces, and parcels thereof
within the
boundaries of Special Improvement Sprinkling Districts Nos. 5, 6, 7, 8 and 9 of
the City of Bozeman, respectively, as heretofore created and established,
the
total amounts as to each entire district and the several amounts as to each lot,
piece, or parcel of land within the boundaries of such district as set forth in
the several schedules attached hereto and made a part hereof and marked sepa-
rately for identification as Schedule One.
The amount so levied and assessed is 100 percent of such costs for each
and all of said districts.
Section 2
That a particular description of each lot, piece, or parcel of
land with
the name of the owner thereof, and the sum assessed and levied against such
property and owner, or either, is set forth in the schedule of each district as
specified and identified in Schedule Two, attached hereto, and made a part of
th is resolution as aforesa id.
Section 3
That the regular meeting of the Commission of the City of Bozeman to be

held on the 1 st day of October 1990, at 7:00 o'clock p.m., in the Commission
Chamber, City Hall Building, in the Ci
ty of Bozeman, be, and the same
is
hereby designated as the time and
place at which objections to
the final
adoption of this resolution will be heard and considered by each Commissioner.
Section 4
That the Clerk of the City Commission be, and she is hereby ordered to
publish in the Bozeman Daily Chronicle, a daily newspaper of general circulation
printed and published in the City of Bozeman, a notice signed by said Clerk as
such, which notice shal I state that this resolution
levying and assessing the
several amounts set forth in the schedule attached hereto and made a part of as
aforesaid, and for the purposes herein
has been provisionally passed and
adopted by the Commission of the City of Bozeman and is on file in the office of
said Clerk of Commission and subject to inspection during regular office hours,
for a period of ten (10) days from and after the publication of such notice and
at any time during such office hours and at or prior to the regular meeting of
the City Commission to be held on the 1 st day of October 1990, as stated in
Section 3 hereof; that said notice
shall be published one time, and
such
publ ication shall be made not less than ten (10) days before the time set for
hearing and considering objections to the final adoption of this
resolution as
aforesaid.

NO.
2813 LEVYING ASSESSMENT OF ONE
HUNDRED PERCENT OF
COST OF SPRINKLING DISTRICT MAINTENANCE
COSTS FOR
SPECIAL IMPROVEMENT SPRINKLING DISTRICTS
OF THE CITY
OF BOZEMAN FOR THE FISCAL YEAR ENDING JUNE 30, 1990.
NOTICE IS HEREBY GIVEN that at a regular session of the Commission
of the City of Bozeman held on the 17th day of September 1990,
Commission
Resolution No. 2813 was provisionally passed and adopted; that said Commission
Resolution No. 2813 levies and assesses a special assessment of taxes upon all
the property in Special Improvement
Sprinkling Districts of said City of
Bozeman to defray one hundred percent (100%) of the cost of sweeping streets
within said Special Improvement Sprinkling Districts for the fiscal year ending
June 30, 1990.
That said Special Improvement Sprinkling Districts,
and the Resolution
creating the name and the amount of the assessments are as follows:

NOTICE IS FURTHER GIVEN that said Commission Resolution No. 2813 is
now on fi Ie in the office of the Clerk of the Commission, Municipal Building,
Bozeman, Montana, and subject to inspection
of all persons interested for
a
period of ten (10) days; that Monday, the 1 st day of October 1990,
at 7: 00
o'clock p. m. of said day at a regular session of the Commission of the City of
Bozeman. Commission Room, Municipal Building, has been designated as the time
and place when and where said Commission will hear and pass upon any and all
objections that may be made to the final adoption of said Commission Resolution
No. 2813 and the levying of said assessment; and that said Resolution will be
finally passed and adopted at said regular session of said Commission, subject
to such corrections and amendments as may be made upon objections made and
filed within ten (10) days limit as provided by law.
Reference is made to the
Commission Resolutions creating the Special
Improvement Sprinkling Districts above-enumerated, which
Resolutions are on
file in the office of said Clerk of the Commission subject to public inspection
during regular office hours.
