Provisional Adoption Creating a New
Division of Chapter 40 of the Bozeman
Municipal Code Related to Water
Adequacy
Amendment Purpose 1:
•Housekeeping
•Move Water Adequacy Code from Chapter
38 to Chapter 40
•Update references to match current staff title
of Director of Utilities
•No substantive code language changes are
proposed with this ordinance. Code
language requirements related to water
adequacy are unchanged.
Amendment Purpose 2:
•Improve Operational Efficiency
•Place water adequacy provisions in the
same code section as the water efficient
landscape ordinance

and the proposed text is included in the Attachment to the staff
report.
Future Removal of Water Adequacy
provisions from Bozeman Municipal
Code Chapter 38
•In the short term, the Water Adequacy
ordinance will be duplicated in Chapter
40
•With the next Chapter 38 amendment
(anticipated roughly in the Spring of
2027), the Water Adequacy ordinance
will be removed from Chapter 38 and
will reference the ordinance in Chapter
40
