Assuming this is the Middle Creek Ditch, the applicant will need to complete the ditch noticing process with the site plan. The applicant must fill out the Ditch Noticing Checklist found on the planning website and provide the relevant documentation with the subsequent site plan application. As of June 18, 2025, the checklist is required with all concept reviews, site plans, master site plans, subdivision pre-applications, subdivision preliminary plats, and PDZs. Comment Engineering Design Reports: (1) City of Bozeman Design and Construction Standards Chapter 3.2 Design Reports: The applicant must submit water and sewer design reports with the site plan application. Please reference the requirements in this chapter. (2) City of Bozeman Design and Construction Standards - Storm Drainage Design: The applicant must provide a stormwater report with the site plan application. Please reference the stormwater drainage report and maintenance plan requirements in chapter 6.4 and attachment B. Please make sure to include a description of the responsible party or entity for operation, inspection, and maintenance as well as replacement of storm drainage facilities and the legal mechanism for succession/assignment. (3) Please reference the criteria in 38.710.050.A.11.g in the updated UDC for the traffic impact study thresholds. Comment BMC 38.530.020.L - Snow removal storage areas: Please review the code section and provide the following information with the site plan. All parking facilities containing 5 or more parking spaces must provide a snow management plan. The plan must contain the following: 1. Locations for snow storage, which may include on-site landscaped areas, and other open space for at least 15 % of the total area of the site used for parking, access drives, walkways and other paved surfaces; 2. Snow storage is not allowed: a. In the public right-of-way; b. Where it would obstruct line of sight or vision triangle; c. In a location where it blocks fire hydrants, emergency vehicle access or access to other properties; d. Where it will cause unmanageable freeze/thaw and icing of sidewalks, pathways and other paved surfaces; e. Where it obstructs on-site amenities, including but not limited to points of egress, mailboxes, storage areas, and trash enclosures; f. Within any access easement; g. Where placed in a manner which violates the Clean Water Act (CWA) and/or the Montana Pollutant Discharge Elimination System (MPDES), and/or any other federal, state or local law or statute; or h. Where it will cause damage to trees located in the public right-of-way. Comment BMC 38.710.070.C.7.h.(2) - Site Plan Submittal Requirements & BMC 38.710.120.A - Submittal Materials for Activities in or Adjacent to Wetlands and Watercourses With the subsequent site plan submittal, the applicant must provide the following information so the City has complete documentation with the application: 1) If wetlands or watercourses are not present on or adjacent to the subject property, a letter signed by a qualified wetlands professional must be submitted to the city certifying there are no wetlands or watercourses within the subject property or adjacent to the property and describing the methods used to determine that wetlands or watercourses do not exist on or adjacent to the property. or, 2) If a wetland or watercourse is present or adjacent to the property, a wetland and watercourse delineation report must be submitted to the city. When required to determine the wetland or watercourse location and function, the delineation report must consider land outside the boundary of the property proposed for development. Comment Water Rights and Water Adequacy: Prior to the site plan application being deemed adequate for review, the applicant must describe how it intends to satisfy water adequacy requirements in BMC 38.410.110 and meet requirements of BMC 38.710.050.A.19. The information provided should be compiled into a preliminary water adequacy compliance report containing the following: a) A description of water rights associated with the property or otherwise available to the applicant, and a description of whether each respective water right is appurtenant to the property or has been severed from the land title. b) A description of the proposed lots for which a payment of cash in lieu of water rights will be provided and the proposed lots for which deferred compliance of BMC 38.410.130 will be sought. c) A description of the proposed lots for which non-potable irrigation systems will be provided; the anticipated irrigation water demand of each lot; and the water source proposed to supply the non-potable irrigation systems. i) If exempt wells are proposed for irrigation supply, then the applicant must obtain DNRC approval of Form No. 602I Notice of Intent to Appropriate Groundwater prior to adequacy. ii) If exempt wells authorized by DNRC under an approved notice of intent to appropriate groundwater are inadequate to meet the anticipated irrigation demands and existing irrigation water rights are associated with the property or otherwise available to the applicant , then the applicant must: (1) Evaluate the legal elements of the water rights to determine if a DNRC change authorization is required to use the rights as proposed. (2) Confirm that the flowrate and volume of the water rights are adequate to meet the anticipated irrigation water demands. (3) Confirm that existing water conveyance facilities can deliver the water rights from their point of diversion to the proposed place of use. If existing conveyance facilities are inadequate, then provide a description of improvements needed to deliver the water rights to the proposed place of use. d) Provide a copy of the following documents as attachments to the report: i) DNRC-approved notice of intent to appropriate groundwater. ii) Abstracts of water rights associated with the property or otherwise available to the applicant. iii) Copies of any share certificates from a canal company, ditch company, or water users association that are held by the applicant. iv) The annexation agreement for the property. v) Any existing water adequacy agreements pertinent to the property or development. Comment This is actually Minor Subdivision 503C now. A new plat was recorded 9/19/2025 giving it a new legal description. Comment This site has an existing address of 1911 S. 19th Ave. That could be used for this building. Any additional buildings or units would need additional address consideration. Comment FDC/Horn-Strobe shall not be located above landscaping beds. They shall have landing/sidewalk to public way and not be obstructed with future growth of vegetation. Fire Riser Room shall have exterior access with sidewalk to public way and include the Fire Alarm Control Panel. Comment Applicant Questions for Engineering: Snow Storage 3a) Paved areas below overhead canopies where it can be reasonably assumed that snow will fall onto the roof instead of the ground don't need to be included in the snow storage calculation. Comment A portion of the subject property is located within the Meadow Creek Subdivision Signal Payback District boundary. If the subject property did not participate in the original cost of construction of improvements, or previously pay the payback fee, the subject property will be accessed a payback charge prior to final site plan approval. Reference document: https://weblink.bozeman .net/weblink/0/doc/181718/Electronic.aspx Comment Applicant Questions for Engineering: 3c) The applicant is advised that under the citywide agreement with MDT for city maintained urban routes, the review authority for any work in South 19th Avenue is the City of Bozeman. Comment On June 15th, 2024, Ordinance 2155 and Resolution 5586 were adopted by the Bozeman City Commission as well as the associated City of Bozeman Landscape and Irrigation Performance and Design Standards Manual. Projects not deemed "adequate” by June 15, 2024 are now subject to these new code requirements. Changemark W/S Unused water service stubs These water services will need to be used or terminated at the water main. If the fire service is not used in the building, it will need to be terminated as well. Reductions in water service size need to take place within 18" of the curb stop/valve. Changemark W/S Sewer Manhole This sewer manhole casting and cover will need to be completely out of the crosswalk. Changemark Montana State Code Adoption Please note that the State of Montana plans to adopt the 2024 ICC family of Codes sometime in mid to late 2026. Depending on your Building Permit Application submission, it may be subject to the new codes. Comment Provide more information regarding fire hydrants and if any additional ones are proposed Comment BMC 38.700.010.E - The applicant must install a 10 foot shared use path along the S 19th frontage with this project. The applicant may replace the existing sidewalk with asphalt, or widen the existing concrete sidewalk with concrete. The entire width must meet ADA requirements at the end of the project. Comment The stormwater systems on the adjacent developments were sized to meet the City's 2004 Design Standards. The latest City of Bozeman Design and Construction Standards dated October 2024 apply to projects that meet the specify regulatory threshold which is defined as 5,000 sf or more of developed or redeveloped area. This project proposes more than 5,000 sf of developed area and must comply with the latest Design Standards (October 2024). Based on the information provided with the concept review, it is unclear whether the stormwater design for the proposed site will be independent from the adjacent developments, or connected to the adjacent developments. It is unclear whether the drainage basins and drainage calculations will have any overlap between projects. Based on the information provided with the concept review, it is unclear whether the proposed site is part of an existing property owners association for the adjacent development, or whether a separate entity will be responsible for stormwater maintenance on the proposed site. It is unclear whether any existing POA documents will need to be amended to reflect the proposed maintenance responsibilities with this project. With the site plan review, please explain whether the stormwater design, ownership and maintenance responsibility for the proposed project is separate to the adjacent development, or connected to adjacent development. Comment Change the label on C100 from "5' Sidewalk" to "10' Shared Use Path." This required facility was recently installed. If damage to this facility occurs during construction applicant should replace in kind. This facility should extend along Kagy Boulevard for the entire length of the property and should tie into the existing shared use path to the west as needed. Comment BMC 38.530.070, Number of Bicycle Parking Spaces Required: Applicant shall provide bicycle parking as required with provision for both short- and long-term bicycle parking. In addition to showing them on the site plan, please provide details of the type of bicycle rack/facility proposed to be used for both short- and long-term bicycle parking, including the layout on the interior of the building where long-term bicycle parking is noted. Comment BMC38.530.070.C.2, Short-term Bicycle Parking: Applicant shall install short-term bicycle parking as required throughout the site. For short-term parking this would include the maximum distance from building entries. Changemark Gas Connection Gas tie-in not possible due to being in a ditch. Consider alternate location for tie-in that falls outside of ditch. Consider alternate alignment for gas line segment within ditch. Changemark Minimize power and gas under hardscape Consider alternate alignment for power and gas that is not under hardscape. Comment Label proposed electric meter location. Refer to the New Service Guide and Electric Service Requirements & Guidelines on Northwestern Energys website for meter clearance requirements. Refer to the new service guide and gas service requirements & guidelines on Northwestern Energys website for meter clearance requirements. ( https://www.northwesternenergy.com/account-services/for-business/construction-services) The electric utility route will need to be coordinated with Northwestern Energys Construction Engineering Department at a later date, as needed. The gas utility route will need to be coordinated with Northwestern Energys Construction Engineering Department at a later date, as needed. Include proposed 10' wide utility easement locations intended for electric and gas. Easements should be in landscaped areas with no permanent structures. Any variances will require coordination with and approval from NWEs Construction Engineering Department. Comment As you are aware the City of Bozeman has adopted new zoning regulations, commonly referred to as the Unified Development Code or UDC. The UDC was formally adopted by the City Commission on December 16, 2025, with an effective date beginning February 1, 2026. Planning staff comments outlined in this Concept Review application are based on the adopted draft UDC (December 16, 2025 version). The Draft UDC can be found on the city's website: https://engage.bozeman.net/udc. The review process for this proposed application is a site plan application. An updated site plan checklist for the new UDC can be found here: https://www.bozeman.net/home/showpublisheddocument/612/639064825101111298 Comment Commercial development. No residential and no parkland requirement. Comment BMC 38.260.010.B.2 - Primary street lot line. 1. Primary street lot line. 1. A lot line that abuts a primary street. Each lot must have at least one primary street lot line. b. Where a lot abuts only one street, that street is considered a primary street. c. A lot abutting multiple streets must designate at least one as a primary street. d. A lot may abut more than one primary street. e. For lots that abut multiple streets, the primary street is determined using the following: (1) The street or streets with the highest classification; (2) The established orientation of the block; (3) The street abutting the longest face of the block; (4) The street parallel to an alley within the block; (5) The street that the site takes its address from; and (6) The primary street designation of adjacent development, either existing or approved. It appears Kagy was chosen to be the primary lot line based on the layout of the concept design. This is acceptable with the City, but please clearly indicate which lot line type you are choosing to designate each frontage in the application as other items related to the respective lot lines will be affected. Comment BMC 38.220.040.040.3. -B-2M Community Mixed Use Lot Standards. Zoning requires minimum commercial open space at 2% of the entire lot. Please include the percentage in the application (typically on a coversheet or in the project narrative) and show where this is on the plans. Comment BMC 38.220.040.040.4 -Streetscape. Sidewalk width is 6 ft at a minimum in B-2M and sidewalks on the drawings appear to be 5 ft in width. See BMC38.260.050.A.3.a for standards pertaining to sidewalks for informational knowledge and Engineering and Transportation comments on their requirements on the matter. It appears they require a wider shared use path of 10 feet. Their standards are more restrictive and would be required above this standard in the formal submittal. Comment BMC 38.220.040.040.7. Frontage. Build-to is measured on a percentage basis. Please include the percentage of the street-facing facades that fall within the build-to zone. BMC 38.260.080 has more info on the specifics pertaining to the build-to requirements including corner lot specifics. Please include the percentages in the site plan application. The provided percentages and further details will help answer your narrative question as to what is ultimately permissible. Until we have the percentages it is difficult to determine if this standard is being met objectively. Comment BMC 38.220.030.B.1. Vertical Massing. Max height for the B-2M zone is 60 ft unless in a regional commercial and services land use designation. The elevations are not detailed enough to verify this standard is met. With formal application the project will need to demonstrate this requirement is met. Comment BMC 38.220.030.B.5 – Building Standards, Windows. B-2M zoning requires a certain percentage of window transparency for all street-facing building facades depending on the street lot line designation (primary street or side street) and which level the windows are on (ground story or upper story). With formal application the project will need to demonstrate the corresponding window transparency along Kagy Boulevard and South 19th Avenue. Comment BMC 38.220.030.B.6 - Building Standards, Entrances. B-2M zoning requires a street-facing building entrance every 60 ft on facades along a primary street or 100 ft on facades along a side street. BMC 38.260.150 contains standards for entrance design. So far this code standard appears to be met on the north side but there should be at least one street-facing entrance on the building façade along South 19th Avenue that appears to be considered a side street. Comment BMC 38.220.040 Boulevard strip width. Scale on certain plans that show this are not usable in our software. Please choose a fractional scale or include a scale bar if possible. While some plans have a scale bar, others do not. Boulevards in the B-2M zone must be at least 6 feet wide. Comment BMC 38.260.120. – Activation. (Application question “a.” expounded upon here) Activation is the horizontal depth of a building that must contain active uses. 1. Purpose To help minimize the impact of inactive spaces on the public realm and to promote a comfortable, safe, engaging, and attractive built environment. 1. Applicability a. Active depth standards apply to the portions of a building used to meet the required build-to b. The active depth requirement applies to the ground story of a building only. 1. Standards a. Applicable portions of a building must provide the minimum active depth required by the zoning district. b. No more than 20% of the floor area of the required active depth can be used for inactive uses such as storage, hallways, stairwells, elevators, and equipment rooms. c. Parking spaces and other vehicle use areas are not allowed in any portion of the required active depth. 1. Measurement Active depth is measured inward from the exterior face of the building façade. 1. Relief Reduced depths will be considered where the applicant can successfully demonstrate the proposed alternative design and configuration of the space is viable for an active use. To verify that the activation requirement is met, please provide the required build-to calculations. In general, the areas already in in the build-to meet activation but it is difficult to verify that the build-to has yet been met. Providing this information should help demonstrate whether the standard is being met. Comment BMC 38.410.010 B. Natural environment. BMC 38.410.010 – General Standards – Natural environment. The new UDC requires the design and development of all land uses must be properly related to topography, and must, to the maximum extent possible consistent with the other requirements of this chapter, preserve the natural terrain, natural drainage, existing topsoil, trees and other existing vegetation. With formal submittal the applicant is required to provide a response to this review criteria in the submitted narrative. Comment BMC 38.510.040 Non-motorized circulation and design. The proposed site layout is meeting this section requiring all buildings to feature a connection to a sidewalk. Provide or document the following additional circulation requirements with formal submittal: Per paragraph C.3 - Crosswalks are required when a walkway crosses an on-site paved area accessible to vehicles. Crosswalks must contain contrasting material (such as concrete) and/or patterns (such as stamped asphalt), excluding painted surfaces. Provide compliant crosswalks in the drawings and civil details where crosswalks are proposed. Per paragraph C.4 Pedestrian paths through parking lots. Developments must provide specially marked or paved sidewalks through parking areas. At least one walkway must be provided every four rows of parking or at a maximum spacing of 200 feet. The pathways must provide a safe connection to the building entrance and meet the pathway design standards set forth in subsection D. Per paragraph D.2 Pathway design requires 5-foot sidewalks except where the sidewalk is adjacent to perpendicular parking, and an extra 2-feet of walkway is required for vehicle overhang. 7-foot internal sidewalks are required where adjacent to parking spaces. Per paragraph D.3 Pathways must be separated from structures by at least 3-feet of landscaping. Comment BMC 38.510.050.D.3. Drive-through facilities. For reference of standard. Drive through is allowed in this location and in general, in this depiction. Details will be assessed using this code in the formal submittal: “Where allowed, drive through facilities (e.g., drive-up windows) must comply with the following. a. Drive-through lanes, including waiting and holding lanes, must be separated from public view and internal sidewalks by a planting strip (at least five feet wide with continuous plantings of evergreen shrubs and/or trees that will provide continuous evergreen screen at least four feet tall at maturity) and/or a masonry wall at least three feet high. Alternative landscaping schemes may be approved provided they include the masonry wall and a substantial vegetative screen. The landscaping must comply with 38.540. b. Drive-through lanes must not restrict pedestrian access between a public sidewalk and onsite buildings. Walkways must not be located within required stacking space as set forth in . c. Also see 38.320.090.C and 38.530.020.M for related standards.” Comment BMC 38.510.060 – Location and design of service areas and mechanical equipment. With the formal submittal provide the location proposed screening method of all rooftop and ground mounted mechanical equipment, utility meters, and solid waste enclosures (current enclosure if not altered is approvable). Provide any necessary details. Comment 38.520.040. - Building massing and articulation. More detailed elevations will be required at the time of the formal site plan submittal to show these standards contained within this section are met. In general, the facades appear to be following general design guidelines in this section, but dimensioned elevations will be required to verify this. Comment BMC 38.520.050. - Building details. 1. High visibility street corner and gateway sites. All development proposals located at designated high visibility street corners and gateway sites must locate a building or structure within 20 feet of the street corner and include design features that accentuate the street corner. Alternatively, the building could be configured with a corner plaza. Corner design features could include a cropped building corner with an entry feature, decorative use of building materials at the corner, distinctive facade articulation, a sculptural architectural element, or other elements that meet the purpose of the standards. (See code for examples). Comment BMC 38.520.050. - Building details. 1. High visibility street corner and gateway sites. All development proposals located at designated high visibility street corners and gateway sites must locate a building or structure within 20 feet of the street corner and include design features that accentuate the street corner. Alternatively, the building could be configured with a corner plaza. Corner design features could include a cropped building corner with an entry feature, decorative use of building materials at the corner, distinctive facade articulation, a sculptural architectural element, or other elements that meet the purpose of the standards. (See code for examples). Comment 38.520.060. - Building materials Please provide information on building materials via elevations, cutsheets, specification sheets, samples, and/or any other appropriate formats that convey this code section is being met with the formal submittal. Comment BMC Table 38.530.040-4 Minimum and Maximum Parking. Uses: General Services (4,850 SF) and Office (10,282 SF) for a total of 15,132 square feet of personal and general service uses space. These uses allow for a minimum of 30 spaces required and a maximum of 61 spaces permitted. The 67 spaces could be allowed if a parking agreement with neighboring properties per sec. 38.530.050. - Joint use of parking facilities, is provided. Please provide accurate parking calculations and any joint use parking agreements during formal submittal. It is ultimately the applicant’s responsibility to research and provide any prior parking agreements or info on other arrangements. Addresses to the west include (excluding individual unit numbers) 2020 W Kagy Blvd and 2040 W Kagy Blvd. Site plan 23071 University Crossing SP originally entitled the project, and 24217 University Crossing MOD modified the project later on (affecting parking per records). An older site plan appears to be 21-327 University Crossing SP/CUP which could also provide useful information. Address to building/parcel to the south appears to be 1915 S 19th Ave. Pertinent projects may include 22143 Crowley Fleck SP MOD, 21-321 Crowley Fleck Bldg. MOD, 13-293 (Z-13174 for records request file number) Crowley/Fleck Law Office SP/COA. The Gallatin County Clerck and Recorders office should have any recorded agreements if the agreements were required to be recorded at that time. While bicycle parking is shown, please provide the bicycle parking calculations (coversheet) in the application with the formal submittal. Bicycle parking racks must be in compliance with standards and details must be provided with formal submittal too. Comment BMC 38.540.050. - Mandatory landscape and irrigation provisions. 1. Acceptable large trees for use in public rights-of-way are those accepted by the forestry department. Street trees must meet the arboricultural specifications and standards of chapter 16, article 5, division 3. The forestry department publishes a pamphlet listing acceptable species and proper planting methods. Prior to planting street trees, a permit from the forestry department is required. 1. The minimum quantity of trees and other landscaping required and provided in the public right of-way as described in must be designed to complement on-site landscaping and to enhance the proposed development project and the streetscape. 1. Montana Department of Transportation (MDT) review and approval of street frontage landscaping for areas of a project included within or adjacent to rights-of-way subject to MDT jurisdiction must be demonstrated at time of landscape plan submittal to the city. When MDT, in writing, denies street frontage landscaping required by this section the applicant must propose, and the director may approve an alternative street frontage landscaping through a departure. 1. Landscaping and irrigation must comply with boulevard and street median requirements outlined in the most recent version of the City of Bozeman Landscape and Irrigation Performance and Design Standards Manual.
